HomeMy WebLinkAbout18479 ORD - 09/18/1984AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF R. C. ALLEN BY CHANGING THE ZONING MAP IN REFERENCE TRACT 1 OUT OF ANCHOR HARBOR TRACT NO. 1, FROM "A-2" APARTMENT HOUSE DISTRICT AND "R-2" MULTIPLE DWELLING DISTRICT TO "B-4" GENERAL BUSINESS DISTRICT; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of R. C. Allen for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, September 18, 1984, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on a Tract 1 out of Anchor Harbor Tract No. 1, as described by metes and bounds below, situated in the City of Corpus Christi, Nueces County, Texas, be changed from "A-2" Apartment House District and "R-2" Multiple Dwelling District to "B-4" General Business District: Being a portion of Anchor Harbor Tract No. 1, as filed in the Map Records of Nueces County, Texas at Vol. 30, Page 83, being also a portion of Lot 2, Section 31, and Lot 1, Section 30, Flour Bluff and Encinal Farm and Garden Tracts, in the City of Corpus Christi, Nueces County, Texas; BEGINNING at a 5/8" iron rod in the northerly right-of-way line of South Padre Island Drive, said point being the southerly corner of Anchor Harbor Tract No. 3; THENCE, with the northerly right-of-way line of South Padre Island Drive N 63°36'30" W, 157.06' to a point; THENCE, continuing with said northerly right-of-way line N 67°54'00" W, 200.44' to a point; 184'79 THENCE, continuing with said northerly right-of-way line N 63°36'30" W, 44.16' to a 5/8" iron rod, the westerly corner of Anchor Harbor Tract No. 1; THENCE, with the northwesterly line of Anchor Harbor Tract No. 1, N 29°00'00" E, 473,24' to a point; THENCE, S 61°00'00" E, 400.00' to a point in the southeasterly line of Anchor Harbor Tract No. 1; THENCE, with said southeasterly line S 29°00'00" W, 440.00' to the point of beginning, said tract containing 4.173 acres of land, more or less. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 18th day of September, 1984.
