AUTHORIZING THE EXECUTION OF THE DOCUMENTS NECESSARY FOR THE
ACQUISITION OF PARCEL 1 IN CONNECTION WITH THE PURDUE ROAD
STREET IMPROVEMENTS, PHASE II PROJECT; APPROPRIATING $6,250;
AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be authorized to execute the
documents necessary for the acquisition of Parcel 1 in connection with the
Purdue Road Street Improvements, Phase II Project, a substantial copy of which
is attached hereto and made a part hereof, marked Exhibit "A."
SECTION 2. That there is hereby appropriated $6,250 out of the
No. 220 Street Bond Fund.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need to take
immediate action to preserve and protect public property by expediting the
purchase of land necessary for the abovementioned project, such finding of an
emergency is made and declared requiring suspension of the Charter rule as to
consideration and voting upon ordinances or resolutions at three regular
meetings so that this ordinance is passed and shall take effect upon first
reading as an emergency measure this the 25th day of September, 1984.

THAT D. H. Luzius and wife, Marie J. Luzius,
of the County of Nueces, State of Texas, for and in considera-
tion of the sum of Five thousand Dollars and no cents
($5,000.00)
to us in hand paid by the City of Corpus Christi, Nueces
County, Texas, and other good and valuable considerations, the
receipt of which is hereby acknowledged, have granted and con-
veyed and by these presents do grant and convey unto the City
of Corpus Christi, Nueces County, Texas, a municipal corpora-
tion duly incorporated under and by virtue of the laws of the
State of Texas, its successors and legal representatives, the
free and uninterrupted use, liberty, privilege, and easement
of going in, on, over, under and along a certain tract of land
situated in Nueces County, Texas, and being described as
follows:

Being an irregular strip out of and along the north
boundary of the northeast of Lot 17, Section 49,
Flour Bluff and Encinal Farm and Garden Tracts as
recorded in Nueces County, Map Records, Volume A,
Pages 41-43 and more completely described as
follows;
Beginning at the north corner of said Lot 17, same
being the intersection of the centerlines of Purdue
Road and Flour Bluff Drive;
Thence S. 61° E., 20 feet along the centerline of
Purdue Road;
Thence S. 29' W., 20 feet to the true point of
beginning of the tract herein described;
Thence S. 61° E., 640 feet parallel with and 20'
from the centerline of Purdue Road;
Thence S. 29° W., 10 feet along the common boundary
of Lots 17 and 18 of said Section 49;
Thence N. 61° W., 610 feet;
Thence in a westerly direction, 15.71 feet along a
circular curve having a radius of 10 feet and
internal angle of 90';
Thence radially N. 61° W., 20 feet;
Thence N. 29° east, 20 feet, parallel with and 20
feet from the centerline of Flour Bluff Drive,
to the point of beginning and containing .152
acres, more or less.

A map of which is marked "Exhibit A" and attached hereto
and made a part hereof for all purposes.
Together with the free ingress, egress, and regress to and
for the City of Corpus Christi, for the purpose of constructing
streets, sidewalks, curbs, gutters and appurtenances upon said
tract and way for the public use by foot, with automobiles,
carts, carriages, and all other vehicles and all other means of
transportation necessary or convenient at all times and in all
seasons in, along, and upon said tract and way, as well as for
laying, repairing, servicing, and maintaining of public utility
lines and storm sewers in, on, over, under, and along said
tract or way.
TO HAVE AND TO HOLD, all and singular, the rights and
privileges aforesaid to the City of Corpus Christi, Texas, its
successors and legal representatives and the public, for the
proper use as public streets and utility easements or utility
easements for so long as used for such purposes or any of them,
and if the use for said tract and way for all of said uses be
ever abandoned, then in that event, the aforesaid rights and
privileges shall cease, and all rights herein granted shall
revert to the Grantor herein, his heirs or assigns.
