HomeMy WebLinkAbout18484 ORD - 09/25/1984AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF COUNTRY MEADOWS LIMITED BY CHANGING THE ZONING MAP IN REFERENCE TO A PORTION OUT OF THOMAS GALLAGHER 400 ACRE SURVEY NO. 402, ABSTRACT NO. 988, NUECES COUNTY, TEXAS, FROM "R -1B" ONE -FAMILY DWELLING DISTRICT AND "I-2" LIGHT INDUSTRIAL DISTRICT TO "T -1B" MOBILE HOME PARK DISTRICT; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Country Meadows Limited for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, September 25, 1984, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on a portion out of Thomas Gallagher 400 acre Survey No. 402, Abstract No. 988, Nueces County, Texas, as described by metes and bounds below, situated in the City of Corpus Christi, Nueces County, Texas, be changed from "R -1B" One -Family Dwelling District and "I-2" Light Industrial District to "T -1B" Mobile Home Park District: Being a portion of the 10.500 acre John W. Huston survey dated July 24, 1971, out of the Thomas Gallagher 400 acre survey No. 402, Abstract 988, Nueces County, Texas, Reference Deed 209-587, Highway right-of-way Deed 885-56, said tract being more particularly described by metes and bounds as follows: COMMENCING at the southwest corner of Lot 1, Block 1, South Clarkwood Acres as shown on map thereof recorded in Volume 36, Page 121 of Map Records of Nueces County, Texas, also being a point on the east right-of-way boundary of South Clarkwood Road, also known as FM 2292, from which a concrete monument found bears North 14° 48' West 10.5 feet; 18484 THENCE with said east right-of-way boundary of South Clarkwood Road South 14° 48' East 243.89 feet to a 5/8 -inch iron rod found for the beginning of an offset in the right- of-way boundary; THENCE South 78° 54' East 16.32 feet to a 5/8 -inch iron rod found for a corner in the right-of-way offset; THENCE South 0° 32' East 59.59 feet to a 5/8 -inch iron rod found for the end of said offset; THENCE continuing with said east right-of-way boundary South 14° 48' East 5.46 feet to a 5/8 -inch iron rod found for the northwest corner of said John W. Huston survey; THENCE leaving said •east right-of-way boundary with the north boundary of said John W. Huston survey North 89° 22' East 447.67 feet to a 5/8 -inch iron rod set for the most northwestern corner of the tract herein described and POINT OF BEGINNING; THENCE continuing with the north boundary of said John W. Huston survey and the north boundary of this tract North 89° 22' East 169.36 feet to a 5/8 -inch iron rod set for the northeast of this tract, at the intersection with a circular curve to the south, said circular curve having a radius point bearing South 78° 02' 09" West 1605 feet, a central angle of 07° 23' 33", a tangent length of 103.68 feet, and an arc length of 207.08 feet; THENCE with said circular curve to the south an arc distance of 207.08 feet to a 5/8 -inch iron rod set for the most eastern southeast corner of this tract, in the intersection with the centerline of a 50 foot roadway easement, said point of intersection bearing South 89° 22' West 496.69 feet from the point of intersection of the centerline of said 50 foot roadway easement with the west boundary line of a 190 foot wide easement and right-of-way; THENCE with the centerline of said 25 foot wide roadway easement South 89° 22' West 156.11 feet to a 5/8 -inch iron rod set for an inside corner of this tract; THENCE South 0° 35' 36" East 205.05 feet to a 5/8 -inch iron rod set in the south boundary of said John W. Huston survey for the most southeastern corner of this tract; THENCE with the south boundary of said John W. Huston survey and the south boundary of this tract South 89° 22' West 440.34 feet to a 5/8 -inch iron rod found in the east right- of-way boundary of South Clarkwood Road for the southwest corner of the John W. Huston survey and this tract; THENCE with said east right-of-way boundary of South Clarkwood Road and the west boundary of the John W. Huston survey and this tract North 0° 32' West 93.0 feet to a concrete monument found for the beginning of a circular curve to the left. Said circular curve has a radius point which bears South 89° 28' West 1005 feet, a central angle of 06° 24' 02", a tangent length of 56.19 feet and an arc length of 112.27 feet; THENCE with said circular curve to the left along the east right-of-way boundary of South Clarkwood Road an arc distance of 112.27 feet to a 5/8 -inch iron rod set in the centerline of 25 foot wide roadway easement for an outside corner of this tract; THENCE leaving said east right-of-way boundary of South Clarkwood Road with the centerline of said 25 foot wide roadway easement North 89° 22' East 405.28 feet to a 5/8 - inch iron rod set for an inside corner of this tract; THENCE North 00° 35' 36" West 205.05 feet to the POINT OF BEGINNING, containing in all 2.95 acres, more or less. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolu- tions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 25th day of September, 1984.
