AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE A
CONTRACT BETWEEN THE CITY OF CORPUS CHRISTI AND CORPUS
CHRISTI LAND VENTURE ASSOCIATES FOR THE ANNEXATION OF
APPROXIMATELY 488.11 ACRES OF LAND BEING A PORTION OUT OF
LOTS 20 THRU 23, 26 THRU 32 AND ALL OF LOTS 24 AND 25,
SECTION 10, PORTIONS OUT OF LOTS 1, 4 THRU 7, 16 THRU 20,
ALL OF LOTS 2, 3, 8 THRU 15, FRACTIONAL SECTION 9, A PORTION
OF LOT 1, FRACTIONAL SECTION 8, AND LOTS 25 THRU 32,
SECTION 6, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS,
NUECES COUNTY, TEXAS, BEING PLATTED AS KING'S CROSSING UNIT
I; FINDING ALL OF SAID LAND TO LIE ENTIRELY WITHIN THE
EXTRATERRITORIAL JURISDICTION OF THE CITY OF CORPUS CHRISTI,
TEXAS, ADJOINING, CONTIGUOUS, AND ADJACENT THERETO;
PROVIDING FOR SEVERABILITY;
WHEREAS, Corpus Christi Land Venture Associates is owner in fee simple
of the hereinafter particularly described tract or parcel of land adjoining,
contiguous and adjacent to the City of Corpus Christi and wholly within its
extraterritorial jurisdiction; and
WHEREAS, the said owner is desirous of contracting with the City for
the annexation of said territory to the City of Corpus Christi; and
WHEREAS, public hearings were duly held on September 24, 1984, and on
September 25, 1984, at the Regular Council meeting of the City Council,
following publication of due notice of said hearing in the official newspaper,
pursuant to Article 970a, V.A.C.S., Texas, as amended, for the consideration of
institution of proceedings for the annexation of defined area wholly within the
extraterritorial jurisdiction of the City of Corpus Christi, more particularly
described by metes and bounds as hereinafter set forth, at which all interested
persons were afforded an opportunity to be heard, and by motion duly made,
seconded and carried the said hearing was closed September 25, 1984; and
WHEREAS, it has been determined by the City Council that the territory
within said tract or parcel of land, now proposed to be annexed, abuts and is
contiguous and adjacent to the City of Corpus Christi and constitutes lands and
territories subject to contractual annexation as provided by the City Charter
Article I, Section 2c; and
WHEREAS, it has been determined that it would be advantageous to the
City and to its citizens and in the public interest to annex the aforesaid lands
and territory hereinafter described:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the City Manager of the City of Corpus Christi is
hereby authorized and directed to execute a contract between the City of Corpus
Christi and Corpus Christi Land Venture Associates, a true copy of which

contract is attached hereto and by this reference incorporated herein for all
purposes, including exhibits thereto, as though fully set forth herein, for
annexation of land and territory described as follows:
FIELDNOTES for a 488.11± acre tract of land comprised of
portions of Lots 20 thru 23, 26 thru 32, all of Lots 24 and
25, Section 10, portions of Lots 1, 4 thru 7, 16 thru 20,
all of Lots 2, 3, 8 thru 15, Fractional Section 9, a portion
of Lot 1, Fractional Section 8, Flour Bluff and Encinal Farm
and Garden Tracts, a map of which is recorded in Volume A,
Pages 41 thru 43, Map Records of Nueces County, Texas and
Lots 25 thru 32, Section 6 said Flour Bluff and Encinal Farm
and Garden Tracts, Nueces County, Texas:
BEGINNING at a point, the intersection of the South
right-of-way line of 80' wide Yorktown Boulevard and the
West right-of-way line of 40' wide County Road 13, for the
Northeast corner of this tract;
THENCE South 29°02'50" West, along the West right-of-way
line of said County Road No. 13, a distance of 5,870.00
feet, more or less, for the Southeast corner of this tract;
THENCE North 60°57'10" West 102.13 feet for the point of
curvature of a circular curve to the left whose radius point

SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction, it
shall not affect any other section, paragraph, subdivision, clause, phrase, word
or provision of this ordinance, for it is the definite intent of this City

ANNEXATION CONTRACT

This Contract and Agreement made and entered into in duplicate
originals by and between Corpus Christi Land -Venture Associates, hereinafter
called "owners", and the City of Corpus Christi, Texas, a home -rule city of
more than 200,000 population, a municipal corporation and body politic under
the laws of the State of Texas, situated in Nueces County, Texas, hereinafter
called "City", for good and valuable consideration in hand received by the
parties respectively and upon the covenants and conditions hereafter stated.
WITNESSETH:
The owners are owners in fee simple and of all existing rights,
titles and interests therein of all the following described property located
in Nueces County, Texas, adjacent to and adjoining the corporate limits of
the City of Corpus Christi, lyirg wholly within the extraterritorial juris-
diction of said city, and in whole or in part, within three hundred feet
(300') of the City's present corporate limits, generally delineated on the
map attached hereto and marked Exhibit "A", and being more particularly
described as follows, to -wit:
FIELDNOTES for a 488.11± acre tract of land comprised of portions

It is agreed by and between the parties hereto that the above-
described land and territory shall be included within the corporate bound-
aries of the City of Corpus Christi, Texas, and shall become a part thereof,
subject to the terms of Article I, Section 2, of the City Charter of Corpus
Christi, as amended, and as further prescribed by Ordinance No. 11139 of the
City of, Corpus Christi.
It is further agreed by and between the parties that as an essen-
tial part of the consideration of this Contract, Owners and City will perform
the following conditions:
1. The Developer agrees to dedicate the required width of drainage
right-of-way from the south right-of-way line of Yorktown
Boulevard to the southwest boundary of the tract at Oso Creek.
Said right-of-way dedication will be as required by the Master
Drainage Plan. The dedication to the herein described limits
is to be made concurrently with the first plat to be filed for
record within said tract. When such drainage right-of-way is
used for drainage purposes the facilities shall be constructed
as required by the Master Drainage Plan..
2. The Developer agrees to construct one-half of Cimarron Boule-
vard along the eastern boundary of the tract even though it may
not be within the westerly enc -half of the right-of-way, in
conjunction with each final plat submitted adjacent to Cimarron
Boulevard. Said construction shall be in conformance with the
Master Transportation Plan currently in effect or as amended by
City Council action.
3. The Developer agrees to pay water lot/acreage fees prior to
filing each final plat for said tract in accordance with the
Platting Ordinance.
4. The Developer agrees to pay sanitary sewer lot/acreage fees
prior to filing each final plat for said tract in accordance
with the Platting Ordinance. However, said payments will be
deposited into a fund for the purpose of reimbursing the
Developer of Brighton -Village Units 1 and 2 for the cost of
installing the existing 15 inch sanitary sewer gravity col—
lection line in Cimarron Boulevard, south of Saratoga Boule—
vard, as required by the Annexation Contract for Brighton
-Village Units 1 and 2 authorized by Ordinance No. 16409. After
the repayment obligation for the Brighton -Village Units 1 and 2
Developer has been met, excess lot/acreage fees collected per
the sanitary sewer Ordinance No. 17396 section of the Platting
Ordinance will be deposited in the Sanitary Sewer Trunk Line
Trust Fund as required by Ordinance No. 17396. Any credit
and/or reimbursement requests made by the Developer under the
terms of Ordinance No. 17396 will be authorized only after the
repayment obligation to the Developers of Brighton -Village
Units 1 and 2 has been met.
5. The owners agree to comply with all provisions of the Platting
Ordinance.
6. The City agrees to commence provision of fire, police, health,
sanitation and other usual city services after the effective
date of annexation.
7. The City agrees to accept sewer, street and drainage facilities
