AMENDING THE ZONING ORDINANCE BY AMENDING ARTICLE 31, NEWLY
ANNEXED TERRITORY, BY ADDING TO SECTION 31-5 SUBSECTION,
31-5.75, SETTING FORTH ZONING CLASSIFICATION OF SAID AREA OF
LAND DESCRIBED AS TRACTS 1 AND 2 BEING PORTIONS OUT OF
LOTS 14, 15, AND 16, SECTION 10 FLOUR BLUFF AND ENCINAL FARM
AND GARDEN TRACTS; AND DECLARING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council its
reports and recommendations concerning the application of Agnes L. Polasek for
amendment to the zoning map of the City of Corpus Christi;
WHEREAS, public hearing was held at which hearing all persons wishing
to appear and be heard were heard, to consider the same before the City Council
of the City of Corpus Christi, in accordance with proper notice to the public,
said public hearing having been held on Tuesday, October 9, 1984, at Regular
Council meeting of the City Council in the Council Chamber at City Hall in the
City of Corpus Christi; and the City Council further finds as follows:
(1) That the Planning Commission of the City of Corpus Christi has
found the proposed change in zoning is in the public interest and within the
purpose of the zoning ordinance; and, that permanent zoning of "B-4" on Tract 1
and "A-1" on Tract 2 being portions out of Lots 14, 15, and 16, Section 10,
Flour Bluff and Encinal Farm and Garden Tracts, Nueces County, Texas, more fully
described hereinafter, be granted;
(2) That the agreement for the contractual annexation of the land
described herein to the City of Corpus Christi does not contain any condition of
rezoning said land by the City Council, and that such contract contains no
reference to zoning;
(3) That the permanent zoning as hereinabove set forth be granted to
the aforesaid described and hereinafter more fully described parcels or tracts
of land; and
WHEREAS, by motion duly made, seconded and carried, it was decided by
the City Council that to approve the hereinafter set forth amendments would
serve public health, necessity and convenience and the general welfare of the
City and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus Christi,
Texas, is amended by making the change hereinafter set out.
SECTION 2. That there is hereby amended Article 31 of the Zoning
Ordinance, Section 31-5, by adding a new subsection, 31-5.75 to hereafter read
as follows, such zoning classification of the hereinafter 3escribed properties
to be effective upon annexation:

"Section 31-5.75. The following described tracts of land shall be zoned and
classified as hollows:
"B-4" General Business District on the following more particularly
described tract:
Tract 1
FIELDNOTES for a 21.90 acre tract of land out of Lots 14 and
15, Section 10, Flour Bluff and Encinal Farm and Garden
Tracts, a map of which is recorded in Volume A, Pages 41
thru 43, Map Records of Nueces County, Texas:
BEGINNING at the centerline intersection of South Staples
Street (F.M. Road 2444) and Yorktown Boulevard for the West
corner of said Lot 16 and the West corner of this tract from
which corner a 5/8 inch iron rod found on the centerline of
Yorktown Boulevard bears North 60°57'10" West 0.37 feet;
THENCE North 28°56'00" East, along said centerline of South
Staples Street, same being the Northwest boundary of said
Lot 16, a distance of 820.00 feet for the North corner of
this tract;
THENCE, leaving said centerline, South 60°57'10" East, at
40.00 feet pass the Southeast right-of-way line of South
Staples Street, in all a distance of 1163.31 feet for the
East corner of this tract;
THENCE South 28°56'00" West, at 780.00 feet pass the
Northeast right-of-way line of Yorktown Boulevard, in all a
distance of 820.00 feet to a point on the centerline of
Yorktown Boulevard for the South corner of this tract;
THENCE North 60°57'10" West, along said centerline of
Yorktown Boulevard, same being the Southwest boundary of
said Lots 14, 15, and 16, a distance of 1163.31 feet for the
POINT OF BEGINNING and containing 21.90 acres of land of
which 1.90 acres lies within the 1/2 width (40.00 feet) of
South Staples Street and the 1/2 width (40.00 feet) of
Yorktown Boulevard for a net acreage of 20.00 acres of land.
"A-1" Apartment House District on the following more particularly
described tract:

FIELDNOTES for a 20.70 acre tract of land out of Lots 14,
15, and 16, Section 10, Flour Bluff and Encinal Farm and
Garden Tracts, a map of which is recorded in Volume A,
Pages 41 thru 43, Map Records of Nueces County, Texas:
BEGINNING at a point on the centerline of South Staples
Street (F.M. Road 2444), same being the Northwest boundary
of said Lot 16, for the West corner of this tract, from
which corner the centerline intersection of South Staples
Street and Yorktown Boulevard bears South 28°56'00" West
820.00 feet, said centerline intersection being the West
corner of said Lot 16;
THENCE, North 28°56'00" East, along said centerline of South
Staples Street, 382.03 feet for the North corner of this
tract;
THENCE, Leaving said centerline, South 60°57'10" East, at
40.00 feet pass the Southeast right-of-way line of South
Staples Street, in all a distance of 1543.74 feet for the
East corner of this tract;
THENCE South 28°56'00" West, at 1162.03 feet pass the
Southwest right-of-way line of Yorktown Boulevard, in all a
distance of 1202.03 feet to a point on the centerline of
Yorktown Boulevard, for the South corner of this tract;
THENCE North 60°57'10" West, along said centerline of
Yorktown Boulevard, same being the Southwest boundary of
said Lots 14 and 15, a distance of 380.42 feet for a corner
of this tract;
THENCE, Leaving said centerline, North 28°56'00" East, at
40.00 feet pass the aforementioned Southwest right-of-way of
Yorktown Boulevard, in all a distance of 820.00 feet for an
inside corner of this tract;
THENCE North 60°57'10" West, at 1123.31 feet pass the
Southeast right-of-way line of South Staples Street, in all
a distance of 1163.31 feet for the POINT OF BEGINNING and
containing 20.70 acres of land of which 0.70 acre lies
within the 1/2 width (40.00 feet) of South Staples Street
and the 1/2 width of Yorktown Boulevard for a net acreage of
20.00 acres of land.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be, and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1937, as amended from time
to time, except as herein changed, shall remain in full force and effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by granting the aforesaid zoning
change, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances
or resolutions at three regular meetings so that this ordinance is pa sed and
shall -44e effect upon first reading as an emergency measure this the day

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
