HomeMy WebLinkAbout18507 ORD - 10/09/1984AN ORDINANCE AMENDING THE ZONING ORDINANCE BY AMENDING ARTICLE 31, NEWLY ANNEXED TERRITORY, BY ADDING TO SECTION 31-5 SUBSECTION, 31-5.74, SETTING FORTH ZONING CLASSIFICATION OF SAID AREA OF LAND DESCRIBED AS A PORTION OUT OF LOT 15, SECTION 6 FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Tristar Development, Inc. for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, October 9, 1984, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and the City Council further finds as follows: (1) That the Planning Commission of the City of Corpus Christi has found the proposed change in zoning is in the public interest and within the purpose of the zoning ordinance; and, that permanent zoning of "AB" on a portion out of Lot 15, Section 6, Flour Bluff and Encinal Farm and Garden Tracts, Nueces County, Texas, more fully described hereinafter, be granted; (2) That the agreement for the contractual annexation of the land described herein to the City of Corpus Christi does not contain any condition of rezoning said land by the City Council, and that such contract contains no reference to zoning; (3) That the permanent zoning as hereinabove set forth be granted to the aforesaid described and hereinafter more fully described parcels or tracts of land; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendments would serve public health, necessity and convenience and the general welfare of the City and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF t CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That there is hereby amended Article 31 of the Zoning Ordinance, Section 31-5, by adding a new subsection, 31-5.74 to hereafter read as follows, such zoning classification of the hereinafter described properties to be effective upon annexation: 18507 "Section 31-5.74. The following described tracts of land shall be zoned and classified as f 11ows: "AB" Professional Office District on the following more particularly described tract: FIELDNOTES for 11.29 acres, more or less, of land out of Lot 15, Section 6, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, Pages 41-43, Map Records of Nueces County, Texas; BEGINNING at a drill hole found in a 2.0 foot diameter concrete base for a post at the common corner of Lots 14, 15, 18, and 19, said Section 6 for the South corner of this survey; THENCE North 60°55'15" West, along the Southwest boundary of said Lot 15 and also the centerline of 40.00 foot wide Yorktown Boulevard (unimproved), 559.53 feet, more or less, for the West corner of this tract; THENCE North 29°02'30" East, at 20.00 feet pass the Northeast boundary line of Yorktown Boulevard, in all a distance of 880.49 feet, more or less, to the North corner of this tract; THENCE South 60°57'25" East 557.77 feet, more or less, to a point on the common boundary line of said Lot 14 and 15 for the East corner of this tract; THENCE South 28°55'40", West along said common boundary line, at 860.85 feet, more or less, pass the Northeast boundary line of said Yorktown Boulevard, in all a distance of 880.85 feet to the Point of Beginning. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall tok effect upon fir3st reading as an emergency measure this the 94 ,day of ( iairT1CA°II , 19X / ATTEST: ecretary MAYOR APP jin OVED: DAY OF [�P & 1 , 19 J.
