HomeMy WebLinkAbout18508 ORD - 10/09/1984AN ORDINANCE AMENDING THE FOLLOWING SECTIONS OF THE PLATTING ORDINANCE: SECTION IV, DESIGN STANDARDS, G, PARKS AND PLAYGROUNDS, PARAGRAPH 1 BY ADDING A NEW SUBPARAGRAPH (d) IN REGARD TO WETLANDS NOT BEING ACCEPTED AS SATISFYING PARK DEDICATION AND RENUMBERING SUBPARAGRAPHS (d),(e), (f), and (g) to (e), (f), (g) and (h); SECTION II, DEFINITIONS, BY ADDING A NEW PARAGRAPH J DEFINING WETLANDS; SECTION IV, DESIGN STANDARDS, G, PARKS AND PLAYGROUNDS, PARAGRAPH 1 BY AMENDING SUBPARAGRAPH (b) IN REGARD TO DEPOSITING MONEY IN LIEU OF PARK DEDICATION; AND SECTION III, PROCEDURE B. GENERAL PROCEDURE, PARAGRAPHS 3, 4, 6, AND 7 IN REGARD TO SPECIFIC TIMES FOR SUBMISSION OF PLATS; AND DECLARING AN EMERGENCY. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Section IV, Design Standards, Paragraph G, Parks and Playgrounds, Subparagraph 1(d) of the Platting Ordinance be and is hereby amended to read as follows, and subparagraphs (d), (e), (f), and (g) are renumbered as (e), (f), (g), and (h): rr d. Within any residential subdivision that includes wetlands which would require an individual permit from the U.S. Army Corps of Engineers for the discharge of fill or dredge material, those wetlands shall be excluded from the calculation of land area which must satisfy the park requirement as described herein. Additionally, those wetlands will,;not be accepted as satisfaction of the park requirement. Determination of those wetlands shall be made by a representative of the U.S. Array Corps of Engineers and shall be the responsibility of the developer. Wetlands which may not be accepted as satisfaction of the park requirement may be donated as a gift to the City for use as passive recreational open space. " SECTION 2. That Section II, Definitions, of the Platting Ordinance be and is hereby amended by adding Paragraph J to read as follows: rr J. Wetlands --those areas that are inundated or saturated by surface or ground water at a frequency and duration sufficient to support, and that under normal circumstances do support, a prevalence of vegetation typically adapted for life in saturated soil conditions. Wetlands generally include swamps, marshes, bogs and similar areas." 18508 SECTION 3. That Section IV, Design Standards, Paragraph G, Parks and Playgrounds, Subparagraph 1(b) of the Platting Ordinance be and is hereby amended to read as follows: 11 (b) Within any residential subdivision of 20 acres or more, located within the city or within the area of extraterritorial jurisdiction of the city, the subdivider shall be required to dedicate 5 percent of the total area of the subdivision for park purposes at a location to be designated by the Planning Commission. However, within any residential subdivision of 20 acres or more containing lots of one (1) acre or larger, the subdivider shall have the right to request that the park dedication be satisfied by depositing monies in accordance with paragraph (a) (2) above. The subdivider shall also be required to file restrictive covenants to provide that these lot areas shall not be reduced until a satisfactory replat of such subdivision or portion thereof is approved by the Planning Commission. The plat shall be submitted to the Park Board for review and recommendation as to the designation of land for park purposes or monies in lieu of park land dedication. To be considered by the Commission, such recommendation shall be submitted to the Department of Planning by the Monday prior to the Planning Commission meeting at which the plat is scheduled to be considered." SECTION 4. That Section III, Procedure, Subsection B, General Procedure, Paragraphs 3, 4, 6, and 7 of the Platting Ordinance be and is hereby amended to read as follows: " 3. Type I and II plats shall be submitted to the Planning Department no later than 19 days prior to the date at which formal consideration of the plat is to be made by the Planning Commission. 4. Type II plats shall be submitted to the Planning Department no later than 33 days prior to the date at which formal consideration of the plat is to be made by the Planning Commission. 6. The Staff Plats Committee, as designated by the Director of Planning, shall meet at 8:30 a.m. Wednesday 9 work days from the submission date. 7. On Tuesday prior to the Planning Commission meeting, corrected plats shall be submitted no later than 12:00 noon. Failure to meet this deadline shall require a resubmittal of the plat as if it were a new submission." SECTION 5. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the immediate need for efficient and effective administration of City affairs by amending the the Platting Ordinance as aforesaid, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 9th day of October, 1984.
