HomeMy WebLinkAbout18509 ORD - 10/16/1984AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF OMNI INTERESTS, INC. BY CHANGING THE ZONING MAP IN REFERENCE TO A PORTION OF LAND OUT OF LOTS 1 AND 2, BLOCK 4, OF THE PARTITION OF PORTIONS OF J. C. RUSSELL FARM BLOCKS, FROM "B-4" GENERAL BUSINESS DISTRICT AND "A-2" APARTMENT HOUSE DISTRICT TO "I-2" LIGHT INDUSTRIAL DISTRICT; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Omni Interests, Inc. for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, October 9, 1984, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on a portion of land out of Lots 1 and 2, Block 4, of the Partition of Portions of J. C. Russell Farm Blocks, as described by metes and bounds below, situated in the City of Corpus Christi, Nueces County, Texas, be changed from "6-4" General Business District and "A-2" Apartment House District to "I-2" Light Industrial District: FIELDNOTES for a 25.48 acre tract of land out of Lots 1 and 2, Block 4, of the Partition of Portions of J.C. Russell Farm Blocks, as shown by map thereof, recorded in Volume 28, Pages 58 and 59, Map Records of Nueces County, Texas; being designated "Baldwin Farms, Inc., Partition of J.C. Russell Farms Partition, Block 4, Portions of Blocks 9, 10, and 11 and a portion of Block 5, Russell Industrial Area", as attached to Warranty Deed from Baldwin Farms, Inc., to S. F. Crecelius and wife Dorothy P. Crecelius, dated July 14, 1969, recorded in Volume 1341, Page 108, Deed Records of Nueces County, Texas: 18509 BEGINNING at a 1 inch iron pipe found at the point of intersection of the North boundary line of Bear Lane (formerly Kosar Road) and the West boundary line of Flato Road for the Southeast corner of this tract; THENCE South 89°56'21" West, along said North boundary line of Bear Lane, parallel to the centerline thereof and 40.00 feet distant therefrom, measured at right angles thereto, 1214.32 feet to the present I-2 zoning line for the Southwest corner of this tract and for the point of curvature of a circular curve to the right whose radius point bears North 43°45'03" East 1545.00 feet and which has a central angle of 32°35'22", a radius of 1545.00 feet, a tangent distance of 451.64 feet and an arc length of 878.79 feet; THENCE, leaving said North boundary line, with said circular curve to the right, along the present I-2 zoning line, 878.79 feet to a point on the South line of Lot 1, Block 4, Gemini Subdivision, a map of which is recorded in Volume 47, Page 87 of said Map Records for the Northwest corner of this tract; THENCE East, at 399.72 feet pass a 5/8 iron rod found on line to mark the Southeast corner of said Lot 1, Block 4, Gemini Subdivision, at 1628.33 feet pass a 5/8 inch iron rod found on line, in all a distance of 1647.22 feet to a point on the West boundary line of Flato Road for the Northeast corner of this tract; THENCE South, along said West boundary line, parallel to the centerline thereof and 20.00 feet distant therefrom, measured at right angles thereto, 749.89 feet for the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 9th day of October, 1984.
