HomeMy WebLinkAbout18532 ORD - 10/23/1984AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF TOMMY RACK BY CHANGING THE ZONING MAP IN REFERENCE TO A PORTION OF LAND OUT OF SURVEY NO. 419, STATE ABSTRACT 570, PATENT NO. 208, AND SURVEY NO. 420, STATE ABSTRACT 857, PATENT NO. 443, FROM "R -1B" ONE -FAMILY DWELLING DISTRICT TO "B-4" GENERAL BUSINESS DISTRICT; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Tommy Rack for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, October 23, 1984, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on a portion of land out of Survey No. 419, State Abstract 570, Patent No. 208, and Survey No. 420, State Abstract 857, Patent No. 443, as described by metes and bounds below, situated in the City of Corpus Christi, Nueces County, Texas, be changed from "R -1B" One -family Dwelling District to "6-4" General Business District: FIELDNOTES for 47.12 acres of land out of Survey No. 419, State Abstract 570, Patent No. 208, and Survey No. 420, State Abstract 857, Patent No. 443, Nueces County, Texas: BEGINNING at a 5/8 inch iron rod found on the North boundary line of Interstate Highway No. 37 for the Southeast corner of this tract; THENCE North 66°26'14" West, with said boundary line of Interstate 37, a distance of 248.88 feet to a Texas Highway Department right-of-way marker found for a corner of this tract; 18532 THENCE continuing with said boundary line, North 69°11'05" West 260.00 feet to a 5/8 inch iron rod found for a corner of this tract; THENCE North 60°17'48" West with the aforementioned North boundary line, 269.00 feet to a 1/2 inch iron rod found for a corner of this tract; THENCE North 55°12'54" West, with said boundary line, 287.64 feet to a 1/2 inch iron rod found for a corner of this tract; THENCE North 69°11'05" West continuing along said boundary line, 677.19 feet to a 1/2 inch iron rod found for a corner of this tract; THENCE North 79°49'32" West with said boundary line 223.09 feet to a 1/2 inch iron rod found for the Southwest corner of this tract; THENCE North 26°26'54' East, leaving the aforementioned North boundary line of Interstate Highway 37, a distance of 419.25 feet for a corner of this tract; THENCE South 60°14'07" East 460.80 feet for a corner of this tract; THENCE North 08°10'32" East 728.18 feet to a point on the centerline of McKenzie Lane (Sid Allison Road 60.00 foot wide) for the Northwest corner of this tract; THENCE South 80°10'32" East, with said centerline of McKenzie Lane, 1646.76 feet for the Northeast corner of this tract; THENCE South 21°46'10" West leaving said centerline at 30.66 feet pass a 1-1/4 inch iron pipe in all a distance of 1258.36 feet to a 1-1/4 inch iron pipe found for a corner of this tract; THENCE South 21°44'08" West 198.00 feet to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is. made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 23rd day of October, 1984.
