HomeMy WebLinkAbout18543 RES - 11/06/1984A RESOLUTION AUTHORIZING THE FILING OF GRANT APPLICATIONS FOR SECTION 5 CAPITAL FUNDS, SECTION 8 TRANSPORTATION PLANNING FUNDS, SECTION 9 OPERATING ASSISTANCE, CAPITAL AND PLANNING FUNDS AND SECTION 9A CAPITAL AND PLANNING FUNDS WITH THE DEPARTMENT OF TRANSPORTATION, URBAN MASS TRANSPORTATION ADMINISTRATION, FOR THE CITY OF CORPUS CHRISTI TRANSIT SYSTEM, DESIGNATING THE CITY MANAGER AS THE AUTHORIZED REPRESENTATIVE; AUTHORIZING EXECUTION OF SAID GRANT APPLICATIONS AND CONTRACT DOCUMENTS AND ANY OTHER NECESSARY DOCUMENTS REQUIRED TO SUBMIT THE APPLICATIONS AND ALL DOCUMENTS NECESSARY TO ACCEPT THESE GRANTS UPON THEIR APPROVAL BY DEPARTMENT OF TRANSPORTATION; AND DECLARING AN EMERGENCY. WHEREAS, the Secretary of Transportation is authorized to make grants for mass transportation projects; and WHEREAS, the contract for financial assistance will impose certain obligations upon the applicant, including the provision by it of the local share of project costs; and WHEREAS, it is required by the U.S. Department of Transportation in accord with the provisions of Title VI of the Civil Rights Act of 1964, that in connection with the filing of an application for assistance under the Urban Mass Transportation Act of 1964, as amended, the applicant give an assurance that it will comply with Title VI of the Civil Rights Act of 1964 and the U.S. Department of Transportation requirements thereunder; and WHEREAS, it is the goal of the applicant that minority business enterprise be utilized to the fullest extent possible in connection with this project, and that definitive procedures shall be established and administered to ensure that minority businesses shall have the maximum feasible opportunity to compete for contracts when procuring construction contracts, supplies, equipment contracts, or consultant and other services: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager is authorized to execute and file applications on behalf of the City of Corpus Christi, Texas, with the U.S. Department of Transportation, to aid in the financing of capital improvements to the City of Corpus Christi Transit System and to aid in the financing of operating assistance projects and transportation planning, respectively; pursuant to Sections 5,0 & 9A of the Urban Mass Transportation Act of 1964, as amended. 18543 SECTION 2. That the City Manager is hereby authorized to execute and file such applications and assurances or any other documents required by the U.S. Department of Transporta 'on effectuating the purposes of Title VI of the Civil Rights Act of a-9&3: /94,L SECTION 3. That the City Manager is authorized to furnish such additional information as the U.S. Department of Transportation may require in connection with the application of the projects. SECTION 4. That the City Manager is authorized to set forth and execute affirmative minority business policies in connection with the projects procurement needs. SECTION 5. That the City Manager is authorized to execute grant agreements on behalf of the City of Corpus Christi with the U.S. Department of Transportation for aid in the financing of operating assistance, capital and planning projects. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient and effective administration of City affairs by filing the above mentioned applications with the U.S. Department of Transportation to aid in public transit improvements, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this resolution is passed and shall take effect upon first reading as an emergency measure this the 6th day of November, 1984. TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance or resolution, an emergency exists requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings; I/we, therefore, request that you suspend said Charter rule and pass this ordinance or resolution finally on the date it is introduced, or at the present meeting of the City Council.
