AN ORDINANCE
AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE WEST 050
INDEPENDENT SCHOOL DISTRICT FOR THE REPAIR, REHABILITATION
AND LIGHTING OF THE FOUR EXISTING TENNIS COURTS, AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That the City Manager is hereby authorized to execute an
agreement with the West Oso Independent School District whereby the City will

SECTION 2 That upon written request of the Mayor Or five Council
members, copy attached, to find and declare an emergency due to the need Of
executing the abovenentioned agreement at the earliest practicable date, such
finding Of an emergency is made and declared requiring suspension of the Charter
rule as to consideration and voting upon ordinances or resolutions at three
regular meetings so that this ordinance is passed and shall take effect upon
first reading as an emergency measure this the tMth day of November, 1984

AGREEMENT
KNOW ALL MEN BY THESE PRESENTS -
This Agreement by and between the City of Corpus Christi (hereinafter
"City") and the West 05o Independent School District (hereinafter "District"):
WITNESSET H.
WHEREAS, the City and the District have an interest in providing
facilities for recreational activities; and
WHEREAS, this objective can be achieved more fully and economically by
cooperation of the City and the District in the construction, maintenance and
utilization of recreational facilities;
THEREFORE, in consideration of the fallowing conditions and covenants
the City and the District mutually agree as follows
1. The City agrees to repair, rehabilitate and light the existing
four tennis courts located an City property adjacent to the Nest Oso High
School, 5002 Bear Lane, Corpus Christi, Texas.
2. The District agrees to pay for utilities for lighting.
3. The City agrees to keep and maintain the courts and lights,
ncluding its fixtures, equipment and the surface of the courts, from damage due
to ordinary wear
and tear, vandalism oraccidents. The District agrees to
regularly cleanthe courts as necessary tokeep the courts in good, playable
condition, and replace the nets installed on the courts as needed.
4. The District shall have the exclusive right to use the courts at
any and all times as may be required for school -sponsored activities, during
which time the District shall be solely responsible for supervision of the use
of the courts. At all other reasonable times, the court shall be available to
the general public as an unsupervised play court.
5. The District agrees to indemnify and save harmless the City of and
from any and all claims for injuries to persons or property by reason of any
employee, agent or
contractor of the District in performing its duties under
this Agreement to provide maintenance, routine clean-up, and supervision of
school functions on the tennis courts.
6. The term of this Agreement shall be month-to-month.
7. No additions or modifications shall be made to the tennis courts
by either party without the written consent of the other party.
IN WITNESS WHEREOF, tlas Agreement is emecuted in duplicate originals
both of equal force and effect as of the day o£ 1984.
