HomeMy WebLinkAbout18563 ORD - 11/20/1984TEXAS AN ORDINANCE AMENDING SECTION 55-151, "PROHIBITION AND REGULATION OF USES", OF THE WATER CONSERVATION ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, TO AUTHORIZE THE PERMITTING OF THE WATERING OF CERTAIN VEGETATION AT SPECIFIED TIMES DURING A CONDITION II WATER SHORTAGE, AUTHORIZING THE PERMITTING OF LAWN WATERING ONCE EVERY TEN DAYS UNDER SPECIFIED CIRCUMSTANCES DURING A CONDITION II WATER SHORTAGE, PROVIDING FOR THE USE OF FIRE HYDRANTS FOR CERTAIN PURPOSES UNDER A CONDITION II WATER SHORTAGE; CONFORMING REMAINING SECTIONS OF THE ORDINANCE TO SUCH AMENDMENTS, PROVIDING FOR PUBLICATION AND AN EFFECTIVE DATE, PROVIDING FOR SEVERANCE, AND DECLARING AN EMERGENCY. BE 1T ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That subparagraph 1 of paragraph 0. Condition II - Water Shortage Watch, of Section 55-151. "Prohibition and Regulation of Uses", of the Water Conservation Ordinance of the City of Corpus Chrlsti, Texas, is hereby amended to read as follows 1. The spr,nkl,ng or watering of lawns is prohibited, provided, however, the City Manager may authorize watering of vegetation as follows: (a) The watering ofshrubbery; annual, biennial or [perennial plants; vines, gardens, vegetables and flowers may be permitted through the means of a hand held hose equipped with a positive shutoffn ozzle, rl g drip ration system, ahand held bucket or watering or sprinkler system which is eitherattended throughout its use or is equipped with an automatic shutoff When authorized, Such watering shall be done only on Tuesday, Thursday, Saturday and/or Sunday. When such watering is authorized during the Daylight Savings Tune pepermitted onlyod f the betweenyear It the hours hof l be ae 6 00 m land 9:00 a.m. and between the hours of 6.00 p.m. and 9 00 p.m 18,563 (0) The watering of lawns may be permitted once very ten days through the means of ahand held hose equipped with a positive shutoff nozzle, a drip irrigation system, a hand held bucket or watering can, or a sprinkler system which is eiher attended throughout its use or is equipped with an automatic shutoff. When authorized, such lawn watering shall be permitted only where the last digit of a customer's street address is the sameas the last digit of the calendar date e g., a customer with street number of 102 would be permitted to water only on the 2nd, 12th and 22nd of each month). No such watering is permitted on the 31st day of any month. For February, street addresses with the last digit of "9" may water on February 28th and street addresses with the last digit of "O" may water on March 1st. (c) Commercial nurseries shall be excepted from the prohibition of this subparagraph and shall be permitted to water nursery stock by means of a hand held hose equipped with a positive shutoffnzzle, drip irrigation system, a hand held bucket or watering sprinkler system which 1s attended throughout its use, is equipped with an automatic shutoff or recaptures and recirculates irrigation water. (d) The allowing of water to run off yards r plants into gutters or streets shall be deemed a waste of water and is prohibited. SECTION 2 That subparagraph 5 of paragraph B Condition II - Water Shortage Watch, of Section 55-151. "Prohibition and Regulation ot Uses., ofthe DB Dater Conservation Ordinance of the City of Corpus Christi, Texas, hereby amended to read as follows: 5. The use of fire hydrants for any purpose other than firefighting is prohibited; except that the City Manaer may permit the use of metered fire hyd ant rater by the City or by commercial operators using ,let rodding equipment to clear and clean sanitary and storm sewers. SECTION 3. That subparagraph 13 of paragraph C. Condition III - Water Shortage Warning, of Section 55-151. "Prohibition and Regulation of Uses , of the Water Conservation Ordinance of the City of Corpus Christi, Texas, is hereby deleted in its entirety. SECTION 4. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision ofthis ordinance shall be held invalid o unconstitutional by final ,Judgment of a court of competent .Jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, far it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION S. This ordinance shall take effect from and after its publication one time in the official publication of the City of Corpus Christi, which publication shall contain the caption stating in summary the purpose of the ordinance. SECTION 6 That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the Immediate need for efficient and effective administration of City affairs by amending the Code as aforesaid such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 20th day of November, 1984.
