HomeMy WebLinkAbout18581 ORD - 12/04/1984• AN ORDINANCE AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE DEPARTMENT OF THE ARMY, CORPS OF ENGINEERS, GALVESTON DISTRICT, PROVIDING FOR CONSTRUCTION RIGHT -OF -ENTRY AT CORPUS CHRISTI BEACH PARK, AND DECLARING AN EMERGENCY BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS. SECTION 1. That the City Manager is hereby authorized to execute an agreement with the Department of the Army, Corps of Engineers, Galveston District, providing for Construction Right -of -Entry at Corpus Christi Beach Park, a substantial copy of which agreement is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2 That upon written request of the Mayor or five Council members, copy attached, to find and declare an mergency due to the need of executing the abovementianed agreement at the earliest practicable date, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and v ting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 4th day of December, 1984 ATTEST: Ci Secretary MAYOR THE LIT OF CORPUS CHRISTI, TEXAS APPROVEDi OAY OF DECEMBER, 1984 0. BRUCE C , CITY ATTORNEY By Assis 2y tto�g'y DD 18581 DEPARTMENT OF TER ARIEL RIGHT -OF -ENTRY FOR CONSTRUCTION Corpus Christi Beach Texas, Corpus Christi Beach Park Restoration Project 6.5 Acres More or less (ProJery, Installation or Activity) (Tract Number or Other Property Identification) The undersigned, hereinafter called the .0wner,. in fulfillment of its obligation as local sponsor to the project, hereby grants to the United States, and its assigns, hereinafter called the Government, a permit or right -of -entry upon Om following terms and conditions 1. The Owner hereby grants to the Government the right to enter upon the lands hereinafter described at any time within a period of two (2) years from the date of this instrument, in order to erect buildings or any other type of improvements, to perform minor excavation and fill, to store and otockpile equipment and materials, and in order to construct a terminal groin. 2. This permit includes the right of ingress and egress on other lands of the Owner not described below, provided that such ingress and egress is necessary and not otherwise conveniently available to the Government. 3. All tools, equipment, buildings, improvements, and other property taken upon or placed upon the land by the Goverryent shall remain the property of the Govenmmnt and may be removed by the Government, at any time within a reasonable period after the expiration of this permit or right -of -entry. 4. The Government shall have the right to patrol and police the lands hereinafter described during the period of this permit or right -of -entry. 5. It is understood and agreed that the Government agrees to be respon- sible for any damage arising from the activity of the Government, its employees and contractors on said lands, in the exercise of rights under this permit or right -of -entry, and shall repair such damages, or, in lieu thereof and at the option of the Government, shall make an appropriate settlement with the Owner. The land affected by this permit or right -of -entry is located in the County of !Amory, State of Texas, and le depicted on a map as Eshibit A attached hereto and made a part Imreof for all purposes.
