HomeMy WebLinkAbout18600 ORD - 12/18/1984AN ORDINANCE AMENDING EXHIBIT "A" OF ORDINANCE 17753 PASSED AND APPROVED BY THE CITY COUNCIL ON AUGUST 3, 1983, REDUCING THE BUILDING AREA, DELETING CERTAIN U5E5, REDUCING THE MAXIMUM AUTHORIZED HEIGHT OF STRUCTURES, REDUCING THE AMOUNT OF SURFACE GROUND FILL AREA AND ALLOWING AMENDMENT OF THE PENDING CORPS OF ENGINEER PERMIT APPLICATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS. SECTION 1. Amending Paragraphs 1.01, 1.02, and 7.05 of Exhibit "0" to Ordinance 17753 passed and approved by the City Council on August 3, 1983, to delete all references to 18 months and substitute therefor 36 months. SECTION 2. Amending Paragraphs 8.01 of Exhibit "8" of Ordinance 17753 passed and approved by the City Council August 3, 1983, to hereafter read as follows: "8 01 Upon completion of the construction the Land Mass as set forth in Article 7 hereof, Lessee shall have the right at ratepeas Coomerciiale SeAreeaco(hereinafterel referred to and to as Buildings) located on Land Mass Tract One ("Bayfront Site"). The Buildings shall contain approximately 80,000 to not more than 100,000 square feet of retail and commercial space to be built in accordance with the Plans and Specifications approved byCity pursuant to Paragraph 8.02 The Buildings may be sublet by Lessee for purposes related to tourist, recreation and water -oriented activities, including the following types of retail and/or commercial activities boutiques, photo kiosks, fast food stores, arcade amusement areaall types of restaurants, shell shops, handi-Craft, woods leather and jewelry shops, sporting goods, household novandeprinthgalleries,i souvenir shops, sailboardaandsb ardart boat shops, nautical gift shops, c a shops, fish, bait and seafood markets, automatic teller machine kiosks, bicycle scooboatser sales, boat sail hardwarewater taxi,aooasa ry shops, boat night accessory s fa ity seve abut In n ages shall 0 re than one a facility serve alcoholic beverages which notisrelated ,t0 a restaurant or spec service facility), yacht clubs, fuel stations, combination shops, travel agencies, and 111 a carts, any Obletaforn thereof The Buildings 5007 will not be used or sublet for residential purposes, hotels or motels." 18600 SECTION 3. Amending Paragraph 8.08(6) of Exhibit "A" of Ordinance 17153 passed and approved by City Council on August 3, 1983, so that the third sentence shall hereafter read as follows .The Buildings would be approximately 80,0000 to not more than 100,000 square feet of retail and commercial mmercial space, with first floor parking, to be limited to a maximum structure of two stories." SECTION 4. Amending Paragraph 10 03 of Exhibit "A" Of Ordinance 17753 passed and approved by City Council on August 3, 1983, to hereafter read as follows "10 03 Lessee agrees to use and develop said Boat Slip Tracts for the construction of approximately 400 boat slips and related small boat harbor facilities. Lessee agrees to place the construction of boat slips as provided in the sn and specifications for Boat Slips Tract A within thirty-six (36) months after the date hereof and to complete said construction within forty-two (42) months after the date hereof. Lessee, or its assigns, shall have the right to sublet the facilities erected on said Boat Slip Tracts upon such rentals and considerations as Lessee shall see fit Before building any structures, docks or wharfs on the Boat Slip Tracts, Lessee shall submit plans for such structures to the City for its review, and if approved by City, City shall Join Lessee in seeking and obtaining all necessary Army Corps of Engineer permits or approval otherwise." SECTION 5. That there is hereby authorized an amendment to the pending Arnd Corps of Engineer Permit application wherebythe surface ground fill area will be approximately eight a rather than the twelve acres described in the currently pending application, and further authorizing the redesign and submission of an amended permit application whereby the design configuration will allow for an enhanced sailing fairway within the marina, that is between the proposed fill and the breakwater. SECTION 6. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision ofthis ordinance shall be held invalid or unconstitutional by final Judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. MOTION 2.3 I -Betty Turner moved and 1,4' /3 Welder Brown seconded the motion to amend the ordinance amending the landmass agreement so as to delete the provision allowing for construction of Tract A. Boat Slips, prior to February 18, 1985, prior to the second reading of said ordinance, first reading having being held an November 13, 1984.
