D. 449428T BY GRANTING A SPECIAL COUNCIL PERMIT FOR TRAILER AND TRAMPOLINE SALES ON A PORTION OF LOT 4A, BLOCK I, GUTH PARKSIDE ANNEX; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of R. D Bennett for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, December 18, 1984, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi, and WHEREAS, by motion duly made, seconded and carried, 1t was decided by the City Council that to approve the hereinafter set forth amendment would best srve public health, n convenience necessity and c nience and the general welfare of the City of Corpus Christi and its citizens NOW, THEREFORE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS SECTION 1. That the Zoning Ordinance 0f the City 0' Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That a Special Council Permit be granted on a portion of Lot 44. Block 1, Guth Parkside Annex, situated in the City of Corpus Christi, Nueces County, Texas, far trailer and trampoline sales, subject to the site plan, a copy of which is attached hereto and made a part hereof, marked Exhibit "Au. and subject to all other considerations of "4-10" One -family Dwelling District. Fieldnotes for 0.429 ac of land proposed for "SP" zoning, out of Lot 44, Block1,,s Guth Parkside Annex, a map of which is recorded in Volume 46, Page 48, Map Records of Nueces County, Texas. 18611 BEGINNING at a point, being the south boundary line of Lot 4A, Block 1 and the west right-of-way line of Rand Morgan Road, as shown to the aforementioned Guth Parkside Annex, for the southeast corner of this tract and the point of beginning, THENCE West, leaving the west right-of-way line of Rand Morgan Road and also being the north boundary line of the Linkenhoger Tract 9, 2.53 acres of Survey 422, Assessors Map 138, Nueces County, Texas, a distance of 170.00 feet, to a point for the southwest corner of this tract. THENCE North, leaving the aforementioned south boundary line of Lot 4A, Black 1, Guth Parkside Annex, a distance of 110.00 feet to a point, for the northwest corner of this tract. THENCE East, a distance of 170 00 feet to a point being the west right-of-way line of Rand Morgan Road and the northeast corner of this tract, THENCE South, with said west right-of-way line of Rand Morgan Road and the original east boundary line of Lot 4A, Block 1, Guth Parkside Annex, a distance of 110 00 feet, to the POINT OF BEGINNING. In the event the Board of Ad,lustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the onspecified in this Special Permit, said Special Permit shall be void and ofno force and effect whatsoever. SECTION 3 That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6 That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs bygranting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 18th day of December, 1984 ATTEST APPROVED DAY OF DECEMBER, 1984 J.
