HomeMy WebLinkAbout18618 ORD - 01/02/1985AN ORDINANCE AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE STATE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION FOR CITY FINANCIAL PARTICIPATION IN THE TRAFFIC SIGNALIZATION IMPROVEMENTS AT TWO INTERSECTIONS -- HORNE ROAD/PORT AVENUE AND HORNE ROAD/PRESCOTT STREET, AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS SECTION 1. That the City Manager be authorized to execute a agreement with the State Department of Highways and Public Transportation for City financial participation in the traffic signalizatian improvements at two intersections -- Horn a Road/Part Avenue and Horne Road/Prescott Street, all a re fully set forthin the agreement, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A." SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need to take immediate action for the preservation of the public peace, health, safety, and general welfare, such finding of a emergency es made and declared requiring suspension of the Charter rule asto consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 2nd day of January, 1985. WHEREAS, the City desires the construction of modernimation of existing traffic signals and incidental items on MI 102 (Port Avenue) and Horne Road and on 091 407 (Horne Road) and Prescott. The c Y has requested the state to construct or have constructed this work. The State will construct or have constructed this work, and the City... pay ten per cen0 (102) of the con- struction cost of this work Or that portion not reimbursable by the Federal Government The estimated construction cost of this work, excluding pre- liminary engineering, 1s one Hundred Ten Thousand Three Hundred Seventy Five and No/100 Dollars ($110,305 00). and the City's estimated ten per cent (10%) share is Eleven Thousand Th y Seven and 50/100 Dollars (511,03] 50) NOW THEREFORE, it is understood that this proposed work will be constructed by the State and the City will transmit to the State with the return of this agreement, executed by the City, a warrant or cheek made ayable to the State Treasurer, Account of Trust Fund No. 927 in the amount of eleven Thousand Thirty Seven and 50/100 Dollars ($11,030.00), to be used in paying or the proposed work, required by the City in the City Of Corpus Christi It is further understood that the State will construct only those "4 46- gie items for the City as requested and required by the City and ten per cent (10%) of the construction cost of such items or that portion not reimbursable by the Federal Government krIll be borne by the City. If upon comPletism of construction, at receipt of bids, or at anytime, it is found that tha amount previously collected is insufficient pay the City's portion, then the City upon request of the State will forthwith supplement this amount by an amount equal to the City's actual share of the cost of this work less the amount previously paid into Trust Fund No. RV. In the event the amount as paid is more than the actual cost, then the excess amount will be returned to the City.
