HomeMy WebLinkAbout18625 ORD - 01/02/1985AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF CIMARRON VENTURE BY CHANGING THE ZONING MAP IN REFERENCE TO A PORTION OUT OF LOT 3, BLOCK 8, WOOLDRIDGE CREEK UNIT 6 FROM "6-1" APARTMENT HOUSE DISTRICT WITH SPECIAL PERMIT TO "3-1" NEIGHBORHOOD BUSINESS 015TRICT, AND DECLARING AN EMERGENCY. WHEREAS, the Planning Conmisscon has forwarded to the City Council its reports and recommendations concerning the application of Cimarron Venture for amendment to thezoning map of the City of Corpus Christi, WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, January 2, 1985, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEKA5 SECTION 1. That the Zoning Ordinance of the City 06 Corpus Christi' Texas, is amended by making the change hereinafter set out SECTION 2. That the zoning on a portion of Lot 3, Block 8, Wooldridge Creek Unit 6, as described by metes and bounds below, situated in the City of Corpus Christi, Nueces County, Texas, be changed from "8-1" Apartment House District with a "SP" Special Permit t0 "5-1" Neighborhood Business District. FI010800E5 for a 3.72 acre tract of land out of Lot 3, Block 8, Wooldridge Creek Unit 6, a map of which is recorded in Volume 47, Page 199, Map Records of Nueces County, Texas. BEGINNING at a 5/8 inch iron rod found at the intersection of the Southwest boundary line of a City of Carpus Christi drainage right-of-way with the Northwest boundary line of Cimarron Drive for the East corner of Lot 3 and the East corner of this tract, THENCE South 29000.00" West, along said Northwest boundary line of Cimarron Drive parallel to the centerline thereof and 30.00 feet distant therefrom, measured at right angles thereto, 579.97 feet to a 5/8 inch iron rod found for the point of curvature of a circular curveto the right whose 1665'5 radius point bears North 61°00'00" West 10 00 feet and which has a central angle of 90°00'00", a radius of 10.00 feet, a tangent distance of 10 00 feet and an arc length of 15 71 feet; THENCE, with said circular curve to the right, 15.71 feet to a 5/8 inch iron rod found on the Northeast boundary line of Misty Meadow Road for the point of tangency and the South end of this tract, THENCE North 61°00'00" Nest, along the Northeast boundary line of Misty Meadow Road, parallel to the centerline thereof and 30.00 feet distant therefrom, measured at right angles thereto, 169.00 feet to a drill hole found in an existing concrete drive for the lower West corner of this tract; THENCE, leaving said Northeast boundary line, North 29°00'00" East 81.00 feet to a drill hole found in an existing concrete drive for an angle point of this tract; THENCE North 01°00'00" West 254 87 feet to a 5/8 inch iron rod found for an inside corner of this tract, THENCE North 61°00'00" West 16.67 feet to a drill hale found in anexisting concrete drive for the upper West corner of this tract, THENCE North 43°59'20" East 80.00 feet to a 5/8 inch iron rod round for an angle point of this tract; THENCE North 13°46'07" East 218.60 feet to a 5/8 inch iron rod found on the Southwest boundary of the aforementioned City of Corpus Christi drainage right-of-way for the North corner of this tract; THENCE South 61°00'40" East, along said Southwest drainage boundary line, at 108.00 feet pass a 5/8 inch iron rod set on line for reference from which rod another 5/8 inch iron rod bears South 28°59'20" West 22.00 feet, in all a distance of 360.00 feet to the POINT OF BEGINNING. SECTION 3. That the official z ming map of the City of Corpus Christi, Texas, be and the sane is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as mended from time to time, except as herein changed, shall remain to full force and effect �,.•l wirw,i SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of anemergency i made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 2nd day of January, 1985.
