HomeMy WebLinkAbout18636 ORD - 01/08/1985AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF TERRY JOHNS, TRUSTEE, BY CHANGING THE ZONING MAP IN REFERENCE TO A PORTION OUT OF LOT 9, BLOCK 2, OSAGE ADDITION, FROM 0-10" ONE -FAMILY DWELLING DISTRICT WITH "SP" SPECIAL PERMIT TO "B-1" NEIGHBORHOOD BUSINESS DISTRICT WITH A "SP" SPECIAL PERMIT FOR THE SALE, RENTAL AND LEASING OF NEW AND USED CARS; AIM DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Terry Johns. Trustee, for amendment to the zoning map of the City of Corpus Christi, WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, January 8, 1985, at Special Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on a portion of Lot 9, Block 2, Osage Addition, as described by metes and bounds below, situated in the City of Carpus Christi, Nueces County, Texas, be changed from "0-18" One -family Dwelling District with a "SP" Special Permit to "0-1" Neighborhood Business District with "SP" Special Permit for the sale, rental and leasing of new and used cars cording to the site plan, a copy of which is attached hereto and made a part hereof, marked Exhibit "A" and restricting signage to that allowed under the "B-1" zoning district. Southwest fifty-two feet of Lot 9 in Black 2. Osage Addition, an addition to the City of Corpus 08118ti, Texas, of record in Volume 21 at Page 67, Map Records of Nueces County, Texas. The PLACE OF BEGINNING is the most westerly corner of Lot 9 and the most northerly corner of lot 8: THENCE, along the boundary ljne of Lot 9, N 29 E 52' to a poinL , 18606 THENCE, 5 61 E 102' to a point; THENCE, 5 29 W 52' to a point on the common boundary line of Lots 8 and 9, THENCE, along the Conon boundary line of Lots 8 and 0,561 W 102' to the PLACE OF BEGINNING. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified in this Special Permit, said Special Permit shall be void and of no force and effect whatsoever. SECTION 3 That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5 That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed SECTION 6.
