AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH ROOTS/FOSTER
ASSOCIATES, INC., PROVIDING FOR ARCHITECTURAL, STRUCTURAL,
MECHANICAL, ELECTRICAL, CIVIL AND RELATED SERVICES NECESSARY
TO DEVELOP DESIGN PLANS AND SPECIFICATIONS FOR AND GENERAL
ADMINISTRATION OF CONSTRUCTION OF THE PADRE ISLAND PUBLIC
SAFETY BUILDING, APPROPRIATING 827,000, AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS
SECTION 1. That the City Manager be authorized to execute
agreement with Roots/Foster Associates, Inc., providing for architectural,
structural, mechanical, electrical, civil and related services
necessary to
develop design plans and specifications for and generaladministration of
construction of the Padre Island Public Safety Building, a copy of which
agreement is attached hereto and made a part hereof marked Exhibit "A".
SECTION 2. That there i5 hereby appropriated $27,000 from the No. 260
Fire Department Building Bond Fund
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need to take
Immediate action to preserve and protect public property by expediting the
construction of public improvements, such finding of an emergency is made and
declared requiring suspension of the Charter rule as to consideration and voting
upon ordinances orresolutions at three regular meetings so that this ordinance
s passed and shalltake effect upon first reading as an emergency measure this

I. Cost Estimates
The Architect Is to provide cost estimates through each phase of the
design of the prosect but does not guarantee the accuracy of such estimates,
however, it is understood that the prosect must be constructed within funds
available The cam( has 5300,000 in funds available for the prosect including
Architect's fees, printing, resident inspection, testang and contingencies.
The design of the prosect shall be such that the cost thereof will not exceed
the above amount. Architect will provide City with a budget slmwing the
various elements and costs of the work through the various phases of work
The City will have the right to require the Architect to make revisions to the
Construction Documents so as to bring the cost within funds available at no
additional fee.
COSIPENSATION
A. Fees Schedule
The City agrees to pay the Architect for has services in designing
and related work a fined fee of Twenty One Thousand rive Hundred Dollars
(021,500 00) for all architectural services.
E. payment Schedule
Upon completion 05 0000 05 000 phases outlaned in Section II,
Paragraphs A through E. and approval and acceptance of same by the City, the
City shall pay the following percentages of the fees as previously outlined
1. Programming and Schematic Phase Fifteen Percent (151)
2. Design Development phase Twenty Percent (208)
3. Construction Document phase 590 02020 (400)
4. Bidding and Contract Phase Five Percent ( 54)
5, Construction Phase Twenty Percent (200
During the Construction Phase, that percentage of the fee due to
Architect shall be paid in monthly installments, the amount of which shall
bear the same relationship to the twenty percent (Mk) as the monthlY
constrnction estimates bears to the total contract price. F11.2. payment will
not be made to the Architect until the conditions of Section s/, Paragraph F,
are met.
C. Ad,ustmenC of Fees

IV. CONTRACT TERM/NATION
The City reserves the right to terminate this contract at any time,
without or without cause. In the event of such termination, the Architect
will be paid a sum proportionate to the state of completion of the phase of
work in which he as then engaged.
