HomeMy WebLinkAbout18649 ORD - 01/15/1985AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF TIM GLOWER BY CHANGING THE ZONING MAP IN REFERENCE TO A PORTION OUT OF LOT 1, SECTION 5, BOHEMIAN COLONY LANDS, FROM 0-1" APARTMENT HOUSE DISTRICT TO "13-4" GENERAL BUSINESS DISTRICT; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Tim Clavier for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, January 8, 1985, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi, and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best srve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens. NOWTHEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEAS. SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out SECTION 2. That the zoning on a portion out of Lot 1, Section 5, Bohemian Colony Lands, described by metes and bounds below, be changed from "A-1" Apartment House District to "5-4" General Business District. Fieldnotes for a 13 605 acre tract of land out of Lot 1, Section 5, Bohemian Colony Lands, a map of which is recorded in Volume A, Pages 48, Map Records of Nueces County, Texas. Beginning at a 5/8 inch iron rod found for the West corner of Lot 1, Block 1, Greenwood Terrace, a map of which is recorded in Volume 39, Page 135, of said Map Records and for the South corner of this tract: Thence N 61°33'30" N, 927.42 feet to the West corner of this tract' Thence N 28°36'00" E, along the Southeast boundary line of a City of Corpus Christi 100.00 foot wide drainage easement, 637.97 feet to the North corner of this tract, 18649 Thence, leaving said Southeast boundary line, S 61°33'30" E, 831.91 feet to the paint of curvature of a circular curve to the right which has a central angle of 08030'04", a radius of 578 33 feet, a tangent distance of 42.98 feet and an arc length of 85.81 feet, Thence, with said circular curve to the right, 85 81 feet to the East corner of this tract, Thence, S 28057'15" W, 629.59 feet to the POINT OF BEGINNING. SECTION 3. That the 0060101 zoning map Of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4 That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs bygranting the aforesaid zoning change, such finding ofnemergency made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 15th day of January, 1985.
