HomeMy WebLinkAbout18658 ORD - 01/15/1985AN ORDINANCE AMENDING THE ZONING ORDINANCE BY AMENDING ARTICLE 31, NEWLY ANNEXED TERRITORY, BY ADDING TO SECTION 31-5 SUBSECTION, 31-5.78, SETTING FORTH ZONING CLASSIFICATION OF SAID AREA OF LAND 0309031900 AS A PORTION OUT OF ANNEX N0. 1 TO THE NUECES RIVER IRRIGATION PARR, AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council Its reports and recommendations concerning the application of Riverside Investors for amendment tothe zoning mapof the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, January 8, 1985, at Special Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and the City Council further finds as follows; (1) That the Planning Commission of the City of Corpus Christi has found the proposed changein ,ning Is in the public interest and within the purpose of the zoning ordinance,and, that permanent zoning of 43-1" on Tract A and "AB" on Tract B both tracts being portions out of Annex No. 1 to the Nueces River Irrigation Park, Nueces County, Texas, more fully described hereinafter, be granted; (2) That the agreement for the contractual a exation of the land described herein to the City of Corpus Christi does not contain any condition of rezoning said land by the City Council, and that such contract contains no reference to zoning, (3) That the permanent zoning as hereinabove set forth be granted to the aforesaid tlescn bed and hereinafter more fully described parcels or tracts of land, and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendments would serve public health, necessity and convenience and the general welfare of the ity and its citizens: e NOWTHEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out SECTION 2. That there is hereby amended Article 31 of the Zoning Ordinance,follows, such zoning . by adding of the, heireinafter -escribed hereafter tees as n g c properties to be effective c upon annexation. 1865S "Section 31-5.79. The following described tracts of land shall be zoned and classified as follows TRACT A Neighborhood Business District on the following more particularly described tracts. Description of 1.119 acres of land, moreor less, being a portion of Nueces River Irrigation ParkAnnex No. 1, a map of which is recorded to Volume "A", Page 55, Map Records, Nueces County, a Texas, and further described by metes and bounds as follows. BEGINNING at a 5/8" iron rod set In the North boundary line of Coastal Bend Subdivision, a map of which is recorded i Volume 47, Page 85, of the Map Records of Nueces County Texas, said beginning point for the Southernmost corner of this tract; THENCE along said North boundary line of Coastal Bend Subdivision N 84°18'43" W 112.50 feet to a 5/8" iron rod found at the Northernmost corner of said Coastal Bend Subdivision for the Southwest corner of this tract, THENCE N 04°40'35" E 11.73 feet to a 5/8" iron rod set at u the point of curvature of a circular curve to the left having a centralangle of 32°29'41", a radius of 380.00 feet and a tangent length of 110.74 feet; THENCE along the a of said circular curve to the left a distance of 215.51 feet to a 5/8" iron rod set at the point of tangency; THENCE N 22°30'38" H 34.33 feet to a 5/8" iron rod set for the Northwest corner of this tract, THENCE N 75°50'31" E 207.13 to a 5/8" iron rod set for the Easternmost corner of this tract; THENCE 5 09°51'00" W 317 77 feet to the POINT OF BEGINNING. TRACT B "A8" Professional office District on the following more particularly described tracts. Description of 3 265 acres of land, moreor less, being a portion of Nueces River Irrigation ParkAnnex No. 1, a map of which is recorded 1n Volume "A", Page 55, Map Records, Nueces County, Texas, and further described by metes and bounds as follows. BEGINNING at a 5/8" i rod found a the Northeast corner of Coastal Bend Subdivision, a map of which is recorded in Volume 47, Page 85, of the Map Records of Nueces County, Texas, said beginning paint for the Southernmost corner of this tract and being in the Westerly boundary line of a Calallen Independent School District tract of land, THENCE along the North boundary line of said Coastal Bend Subdivision N 84°18'43" W 453.35 feet to a 5/8" iron rod set for the Westernmost corner of this tract, 785117E N 09°51'00" E 317.77 feet to a 5/8" iron rod set for the Northernmost corner of this tract. THENCE 5 85°45'00" E 175 00 feet to a 5/8" iron rod set for a Northerly corner of this tract, THENCE 5 79°45'00" E 278 00 feet to a 5/8" iron rod set for the Easternmost corner n of this tract and being i said Westerly boundary line of Calallen Independent School District tract, THENCE 5 09°51'00" W 300 00 feet along said Westerly boundary line of Calallen Independent School District tract to the POINT OF BEGINNING SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same Is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as mended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6.
