CLOSING AND ABANDONING A 5-0007 WIDE UTILITY EASEMENT
IN NAVIGATION HEIGHTS, LOT 9 AND IN NAVIGATION HEIGHTS
UNIT 2, LOT 7, AND A 15 FOOT HIDE DRAINAGE AND UTILITY
EASEMENT IN NAVIGATION HEIGHTS UNIT 2, LOTS 10 AND 11,
SUBJECT TO THE PROVISIONS LISTED BELOW, AND DECLARING AN
EMERGENCY.
WHEREAS, there exists a 5 foot wide utility easement in Navigation
Heights, Lot 9 and 1n Navigation Heights Unit 2, Lot 7, and a 15 foot wide
drainage and utility easement in Navigation Heights Unit 2, Lots 10 and 11, a
corded respectively in Volume 12, Page 7, and in Volume 49, Pages 57 and 58,
Map Records of Nueces County, Texas; and
WHEREAS, it has been determined that it is feasible and advantageous
to the City of Corpus Christi to abandon said easement, subject to the
provisions listed below.

TTE%AHEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

SECTION 1 That a 5 foot wide utility easement in Navigation Heights,
Lot 9 and in Navigation Heights Unit 2, Lot 7, and a 15 foot wide drainage and
utility easement in Navigation Heights Unit 2, Lots 10 and 11, as corded
respectively in Volume 12, Page 7, and in Volume 49, Pages 57 and 58, Map
Records of Nueces County, Texas, m re fully described by metes and bounds
attached hereto and made a part hereof marked Exhibits "A" and "B", be and the
me 1s hereby closed for public use and every municipal purpose, providing for
replotting of affected properties and the dedication of analternate 15 foot
drainage and utility easement and 5 foot utility easement for the purpose of
providing drainage and utility access to Navigation Height Unit 2, Lot 9. The
above described utility easement is hereby abandoned to the owners of the
abutting property in accordance with the laws of the State of Texas and for the
service and interest of the inhabitants of the City of Corpus Christi, Texas
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final ,Judgment of a court of competent ,jurisdiction, it
shall not affect any other section, paragraph, subdivision, clause, phrase, word
r provision of this ordinance, for 1t is the definite intent of this City
Council that every section, paragraph, subdivision, clause, phrase, word or
provision hereof be given full force and effect for its purpose.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare a emergency due to the need to
closeand abandon the abovementioned utility a easements at the earliest
practicable date, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances or

reolutaons at three regular meetings so that this ordinance is passed and shall
take effect upon first reading as an emergency measure this the qday of
January, 1985.
