HomeMy WebLinkAbout18674 ORD - 01/29/1985AN ORDINANCE AMENDING THE 0007111 ORDINANCE UPON APPLICATION OF LESLIE SIMON ANO ,10E OSHMAN, TEXAS COMMERCE BANK TRUSTEE, BY CHANGING THE ZONING MAP IN REFERENCE TO TRACTS 1 AND 2 OUT OF LOTS 12, 13, AND 14, SECTION 27, FLOUR BLUFF AND 141140L FARM AND GARDEN TRACTS FROM "F -R" FARM -RURAL DISTRICT TO "R -1C" ONE -FAMILY DWELLING DISTRICT ON TRACT 1 AND FROM "F -R" FARM -RURAL DISTRICT TO "A-1" APARTMENT HOUSE DISTRICT ON TRACT 2; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Leslie Simon and Joe 05hman, Texas Commerce Bank Trustee, for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, December 11, 1984, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Carpus Christi; and WHEREAS, by motion duly made, seconded and carried, 1t was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens NOW, THEREFORE, BE 1T ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS' SECTION 1. That the Zoning Ordinance Bf the City 01 Corpus Christi. Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on Tracts 1 and 2 out of Lots 12, 13, and 14, Section 27, Flour Bluff and Encinal Farm and Garden Tracts, as described by metes and bounds below, situated in the City of Corpus Christi, Nueces County, Texas, be changed from "0-11" Farm -Rural District to "R-10" One -family Dwelling District on Tract 1 and from "F -R" Farm -Rural District to "0-1" Apartment House District on Tract 2 Tract 1 FIELDN0TE5 for 45 77 acre tract out of Lots 12, 13, and 14, Section 27, Flour Bluff and Encinal Farm and Garden Tracts, map of which is recorded in Volume A, Pages 41, 42, and 43, Map Records of Nueces County, Texas. BEGINNING at a point on the centerline of Wooldridge Road for the lower West corner of this tract from which corner the South corner of Lot2, Block 1, The Forum Mall, a mapof 18674 which is recdrded to Volume 50, Pages 5 and 6, of said Map Records bears North 61°03'20" West 775.00 feet, thence North 29°05'20" East 30 00 feet; THENCE, leaving said centerline, North 28°55'40" East 655.00 feet to an 1091 de corner of this tract; THENCE North 51°03'20" West 400.00 feet to a corner of this tract, THENCE North 28°56'40" East 324.95 feet to an inside corner of this tract, THENCE North 61°03'20" West 372.24 feet to a point on the Northwest boundary line of said Lot 14 for a corner of Lot 3, Block 1, The Forum Mall and for the upper West corner of this tract, THENCE North 29°06'20" East, along said Northwest boundary line, 340.37 feet for thecn corner f Lots 2, 3, 14, and 15, Section 27, of said Flour Bluff and Encinal Farm and Garden Tracts and for the North corner of this tract;' THENCE South 61°04'35" East, along the common boundary line of Lots 3, 4, 5, 12, 13, and 14, Section 27, a distance of 1985.00 feet for the common corner of Lots 5, 6, 11, and 12. said Section 27, and for 510* East corner of this tract, THENCE South 29°04'55" West, along the common boundary line of said Lots 11 and 12, a distance of 1321 05 feet to point an the centerline of Wooldridge Road for the South corner of this tract, THENCE North 61°03'20" West, along said centerline, 1210.54 feet to the POINT OF BEGINNING. Tract 2 FIELDNOTES for 14.42 acres of land out of Lots 13 and 14, Section 27, Flour Bluff and Encinai Faimn and Garden Tracts, map of which is recorded in Volume A, Pages 41 thru 43, Map Records of Nueces County, Texas. BEGINNING at a 5/8 i h i n rod set at the centerline of Wooldridge Road for the Nest corner of Lot 14 and the Weste corner of this tract from which co a 5/8 inch iron rod found bears South 61°03'20" East 2.49 feet, THENCE North 29°05'20" East, along the Northwest line of Lot 14, at 30.00 feet pass the South corner of Lot 2, Block 1, The Forum Mall, a map of which is recorded in 4T Volume 50, Pages 5 and 6 of said Map Records and continuing along the common boundary line of said Lot 14 and Lots 2 and 3, Block 1, of said the Forum Mall, to all a distance of 979.96 feet to the North corner of this tract; THENCE, leaving said common boundary line, South 61°03'20" East 372.24 feet to a corner of this tract; THENCE South 28°56'40" West 324.95 feet to an inside corner of this tract, THENCE South 51"03'20" East 400.00 feet to the East corner of this tract; THENCE South 28.56'40" West 655.00 feet to a point on the centerline of Wooldridge Road for the South corner of this tract; THENCE North 61°03'20" West, along said centerline, 775.00 feet to the POINT OF BEGINNING. SECTION 3 That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding ofnemergency is made and declared requiring suspension of the Charter rule asconsideration and voting upon ordinances or solutions at three regular meetingso that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 29th day of January, 1985.
