HomeMy WebLinkAbout18687 ORD - 02/05/1985AN ORDINNICE AMENDING THE ZONING ORDINANCE BY AMENDING ARTICLE 31, NEWLY ANNEXED TERRITORY, BY ADDING TO SECTION 31-5 SUBSECTION, 31-5.82, SETTING FORTH ZONING CLASSIFICATION OF SAID AREA OF LAND DESCRIBED AS BLOCKS 1. 2, AND 3, SECTION 18, PADRE ISLAND -CORPUS CHRISTI, AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its parts and recommendations concerning the application of the City of Corpus Christi for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, February 5, 1985, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and the City Council further finds as follows. (1) That the Planning Commission of the City of Corpus Christi has found the proposed change III zoning is i n the public interest and within the purpose of the zoning ordinance, and, that permanent zoning of "B -2A" a Blacks 1, 2, and 3, Section 18, Padre Island -Corpus Christi, Nueces County, Texas, be granted; (2) That the agreement for the contractual annexation of the land described herein to the City of Corpus Christi does not contain any condition of zoning said land by the City Council, and that such contract contains no reference to zoning, (3) That the permanent zoning as hereinabove set forth be granted to the aforesaid described and hereinafter more fully described parcels or tracts of land; and WHEREAS, by motion duly made, seconded and carried, 1t was decided by the City Council that to approve the hereinafter set forth amendments would serve public health, necessity and convenience and the general welfare of the City and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, 1s amended by making the change hereinafter set out. SECTION 2. That there i5 hereby amended Article 31 of the Zoning Ordinance, Section 31-5. by adding anew subsection, 31-5.82 to hereafter read as follows, such zoning classificationof the hereinafter scribed property to be effective upon annexation: 15687 ”Section 31-5.82. The following described tracts of land shall be zoned and classified as follows. "8-20" Barrier Island Business District on the following more particularly described tract. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or solutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 5th day of February, 1985.
