AN ORDINANCE
AMENDING THE ZONING ORDINANCE BY AMENDING ARTICLE 31, NEWLY
ANNEXED TERRITORY, BY ADDING TO SECTION 31-5 SUBSECTION,
31-5.81, SETTING FORTH ZONING CLASSIFICATION OF SAID AREA OF
LAND DESCRIBED AS A PORTION OUT OF LOT 8, SECTION 6, FLOUR
BLUFF AND ENCINAL FARM AND GARDEN TRACTS, AND DECLARING AN
EMERGENCY
WHEREAS, the Planning Commission has forwarded to the City Council its
reports and recommendations concerning the application of Rogers Floor Company,
Inc. for amendment to the zoning amp of the City of Corpus Christi,
WHEREAS, public hearing was held at which hearing all persons wishing
to appear and be heard were heard, to consider the same before the City Council
of the City of Corpus Christi, in accordance with proper notice to the public,
said public hearing having been held on Tuesday, January 29, 1985, at Regular
Council meeting of the City Council to the Council Chamber at City Hall 1n the
City of Corpus Christi, and the City Council further finds as follows
(1) That the Planning Commission of the City of Corpus Christi has
found the proposed change in zoning is
in the public interest and within the
purpose of the zoning ordinance; and,that permanent zoning of 13-1" with a
Special Permit for "B-4" signage on Tract 1 and "F -R" on Tract 2, both tracts
being portions of Lot 8, Section 6, Flour Bluff and Encinal Farm and Garden
Tracts, Nueces County, Texas, more fully described hereinafter, be granted;
(2) That the agreement for the contractual a nexation of the land
described herein to the City of Corpus Christi does not contain any condition of
rezoning said land by the City Council, and that such contract contains no
reference to zoning,
(3) That the permanent zoning as hereinabove set forth be granted to
the aforesaid described and hereinafter more fully described parcels or tracts
of land, and
WHEREAS, by motion duly made, seconded and car ried, it was decided by
the City Council that to approve the hereinafter setforth amendments would
serve public health, necessity and convenience and the general welfare of the
City and its citizens.
NOW,
CORPUS CHRISTI,
TTE%ERASHEFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
SECTION 1. That the Zoning Ordinance of the City of Corpus Christi,
Texas, is amended by making the change hereinafter set out.
SECTION 2. That there is hereby amended Article 31 of the Zoning
Ordinance, Section 31-5, by adding a new subsection, 31-5.81 to hereafter read
as follows, such zoning classification of the hereinafter described property to
be effective upon annexation
"Section 31-5.81. The following described tracts of land shall be zoned and
classified as follows

TRACT 1
9-1" Neighborhood Business District with a Special Permit for "13-4"
signage on the following more particularly described tract.
A tract of land out of Lot 8, Section 6, Flour Bluff and
Encrnal Fenn and Garden Tracts, a shown an the map thereof
corded in Volume A, Pages 41, 42, and 43 of the Map
Records of Nueces County, Texas, said tract being more
particularly described by metes and bounds as follows.
BEGINNING 60 feet northeast of the northeast corner
of
Buckingham Estates Unit 1, a subdivision with the plat
thereof recorded in Volume 48, Pages 37, 38, and 39 of the
Map Records of Nueces County, Texas, for the southeast
corner and POINT OF BEGINNING of the tract herein described,
THENCE 60 feet northeast of and parallel with the north
boundary of Buckingham Estates Unit 1 North 61"03'09" West
630.00 feet to a point for the southwest corner of this
tract,
THENCE North 28.65'40" East 269.47 feet to a point for the
northwest corner of this tract,
THENCE South 61°03'09" East 630.00 feet to a point an the
west boundary of South Staples Street for the northeast
corner of this tract;
THENCE with the west boundary of South Staples Street South
20"56'02" West 269 47 feet to the POINT OF BEGINNING,
containing in all 3,90 acres, more or less.

particularly described by metes and bounds as follows

County, Texas, for the southeast corner and POINT OF
BEGINNING of the tract herein described,rne
THENCE with the north boundary of Buckingham Estates Unit 1
and the south boundary of this tract North 61"03'09" West
630.00 feet to a point for the southwest corner of this
tract,

THENCE North 28.55'40" East 60.00 feet to a point for the
northwest corner of this tract,
THENCE South 61°03'09" East 630 00 feet to a paint on the
west boundary of South Staples Street for the northeast
corner of this tract,
THENCE with the west boundary of South Staples Street South
28"56'02" Hest 60.00 feet to the POINT OF BEGINNING,
containing 1n all 0.87 aces, more or less
In the event the Board of Adlustment grants any special exception or
variance to the Zoning Ordinance, applicable to the Special Permit herein
granted, other than the onspecified in this Special Permit, said Special
Permit shall be void and of no force and effect whatsoever
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be, and the same is hereby, amended as herein ordained.
SECTI011 4. That the Zoning Ordinance and Map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1037, as amended from time
to time, except as herein changed, shalt remain in full force and effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That upon written request of the Mayor or five 0009011
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by granting the aforesaid zoning
change, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances
or resolutions at three regular meetings so that this ordinance is passed and
shall take effect upon first reading as an emergency measure this the 12th day
of February, 1985.
