AN ORDINANCE
AUTHORIZING THE EXECUTION OF A CONTRACT WITH PADRE ISLES
PROPERTY OWNERS 4550CIAT000 PROVIDING FOR THE LANDSCAPING OF
CERTAIN MEDIANS IN PADRE ISLES AND THE MAINTAINING IN
PERPETUITY OF SAID MEDIANS BY THE PADRE ISLES OWNERS
ASSOCIATION, APPROPRIATING $15,000.00; AND DECLARING AN
EMERGENCY.
DE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That the City Manager is hereby authorized to execute a
contract with Padre Isles Property Owners Association providing for the
landscaping of Certain medians in Padre Isles and the maintaining In perpetuity
of said medians by the Padre Isles Owners Association, all as re fully set
forth in the contract, a substantial copy of which Is attached hereto and made
a part hereof, marked Exhibit "A". x
SECTION 2. That there is hereby appropriated $15,000 from the
Unrestricted Park Trust Fund.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an
emergency due to the need of
executing the abovementloned contract agreement at the earliest practicable
date, such finding of an emergency Is made and declared requiring suspensson of
the Charter role as to c nsnderation and voting upon ordinances or esolutions
at three regular meetings so that this ordinance is passed and shall take effect
upon first reading as an emergency measure this the 26th day of February, 1985

AGREEMENT

KNOW ALL BY THESE PRESENTS.
COUNTY OF NUECES §
THIS AGREEMENT is entered into between the City of Corpus
Christi, hereinafter called "City", and the Padre Isles Property Owners
Association, Inc., hereinafter called "Association".
WHEREAS, the Association is interested in improving the aesthetic
value of certain streets within the Padre Isles Subdivision located in the
City; and
NOW, THEREFORE, the City and Association agree as follows:
1. The Association will make landscaping improvements in
certain street medians for and on behalf of the City an Whitecap Boulevard
and Commodores Drive which are located in the Padre Isles Subdivision. The
improvements will be made in accordance with the plans and specifications
approved by the Parks and Recreation Department. This Agreement shall be
null and void should the landscaping Improvements not be carried out within
x (6) months from the date of this Agreement or as set out in the
approved plansand specifications o any change therein approved i writing
.,- by the Parks and Recreation Department. The Association agrees to pay a
minimum of Forty-five thousand dollars ($45,000), toward the above
described landscaping casts as shown on the attached landscaping cost
estimate, marked as Exhibit "A", and map, marked as Exhibit W.
2. The City agrees to reimburse the Association an am ount not
to exceed $15,000 The City's payment to the Association willbe made
based an invoices for work completed.
3. The Association agrees to be responsible for the maintenance
of the above-described landscaping in perpetuity and agrees to maintain
such landscaping in accordance with directives from the Parks and
Recreation Department.
4. The Association agrees to indemnify the City against any
claims arising as a result of this project.
5. The Association further agrees, in compliance with City of
Corpus Christi Ordinance No. 17112, to complete, as part of this Agreement,
the disclosure of Ownership Interests farm attached hereto and labeled
.EXHIBIT C".

6. This Agreement shall become effective and shall be binding
upon and shall Imre to the benefit of the parties hereto and their
respective heirs, successors and assigns from and after the date of
execution.

or at the present meeting of the City Council.
