HomeMy WebLinkAbout18741 ORD - 03/05/19851.074.04 AN ORDINANCE AMENDING ORDINANCE N0. 18691 CALLING AN ELECTION FOR MAYOR AND COUNCIL MEMBERS ON APRIL 6, 1905 BY ORDERING AN ELECTION FOR MAYOR AND COUNCIL MEMBERS TO BE HELD JOINTLY IN THE CITY OF CORPUS CHRISTI, TEXAS, WITH THE COUNTY OF NUECE5, TEXAS, ON APRIL 6, 1965; ENACTING OTHER PROVISIONS PERTINENT TO THE SUBJECT OF A JOINT ELECTION; AND DECLARING AN EMERGENCY WHEREAS, since the adoption of Ordinance No. 18691 calling an election for Mayor and Council Members on April 6, 1965, the County of Nueces, Texas, has requested that such an election be held Jointly with a County $25,000,000 Homeport bond election On April 6, 1985, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS. SECTION 1. That Ordinance No 18691 adopted February 12, 1981, be and 1s hereby amended to read as follows SECTION 2 That a regular election is hereby ordered to be held on Saturday, the 6th of April, 1985, Jointly with the County of Nueces, Texas, which election will be held for purpose of electing Mayor and Council members and a $25,000,000 County "Homeport" bond issue election. SECTION 3. Thata t said election, all the qualified voters of the City of Corpus Christi shall be permitted to vote. SECTION 4. That the names of candidates for the office Of Mayor and thecndidates for the office of the City Council members hall be placed n said ballot in the manner and farm prescribed by law and such election shall be held Jointly as permitted by the Texas Election Code, V.C.S. SECTION 5. The expenses Of such election shall be borne by the City and County on a fifty-fifty basis; a single ballot form containing each proposition to be voted on shall be used at each Joint polling place, the poll lists, tally sheets and returns forms for such elections may be combined and multiple sets of the Joint returns of such election may be made by the election officials holding such elections, one set of all returns and tally lists shall be delivered to the City Council of the City of Corpus Christi; and one set of such returns and tally lists shall be delivered to the County of Nueces; and only one set of election precincts, voting laces and election officials (hereinafter designated) shall be used in the conduct of such joint election SECTION 6. County Clerk, Marion Uehlinger is hereby appointed Election Manager and Judge of said election, and she Is hereby authorized and directed to make all necessary arrangements for the holding of saidelectionCity i accordance with and subject to the laws of this State, and Acting Secretary, Dorothy Zahn, is instructed to assist in holding such election in accordance with the laws of this State 1874iMICROFILMED 1 074.04 SECTION 7. Voting machines shall be used for the conduct of said election on election day and for conducting absentee voting, except that for absentee votes cast by mail, paper ballots hall be used. The following official shall conduct the absentee voting County Clerk, Marion Uehlinger, with the assistance of an election clerk to be appointed by Acting City Secretary, Dorothy Zahn. SECTION 8. A special canvassing board shall be used to count the absentee ballots, and the followingpersons are hereby appointed to serve as such special canvassing board, to -wit Mr. John N. Welsh, Chairman Mr. Frank Medina, Jr. Mrs Frank Medina, Jr. Mr Cliff Christine Mrs Cliff Christine Mrs. Sofia Leal SECTION 9 The Acting City Secretary 1s directed to post and publish such election notices as are required by the Election Laws of the State of Texas. SECTION 10. County election precincts and County election judges will be utilized. SECTION 11. By approving and signing this ordinance, the Mayor officially confirms as his action all matters recited in the ordinance which by law come within his ,jurisdiction. SECTION 12. If for any reason any section, paragraph, subdivision, clause, phrase, ward or provision ofthis ordinance shall be held invalid or unconstitutional by final ,judgment of a court of competent Jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, fart is he definite intent of this City Council that every section, paragraph,subdivision, clause, phrase, ward or provision hereof be given full farce and effect for its purpose. Section 13. The fact that 1t is necessary and essential that the governing body of the City of Corpus Christi shall order elections pertaining to municipal affairs and that the notice of such election should be promptly posted and published and that a regular City election for the election of the Mayor and Council members be held ,jointly with the County of Nueces, Texas, in the City of Corpus Christi on the first Saturday in April, 1985, and that the requirements of the Federal Voting Rights Act may be timely met, creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or r esolution shall be passed finally on the date of its introduction but that such ordinance or esolution shall be read at three several meetings of the City Council, and the Mayor, having declared that 1.074.04 such emergency and necessity exist, having requested the suspension of the Charter rule and thatthis ordinance be passed finally an the date of its introduction and take effect and be In full force and effect from and after Its passage, IT IS ACCORDINGLY 50 ORDAINED, this the 5th day of March, 1985.
