HomeMy WebLinkAbout18758 ORD - 03/26/1985.0.41.04 AN ORDINANCE CLOSING AND ABANDONING A TRIANGULARLY SHAPED PORTION OF A 30 FOOT WIDE DRAINAGE EASEMENT IN LOT 23, BLOCK 1, JACKSON PLACE SUBDIVISION, SUBJECT TO THE PROVISIONS LISTED BELOW; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 30 foot wide drainage easeomnt in Lot 27, Block 1, Jackson Place Subdivision, recorded in Volume 23, Pages 90, Map Records of Nueces County, Texas, and WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easement, subject to the provisions listed below NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That a triangularly shaped portion of a 30 foot wide drainage easement an Lot 27, Block 1, Jackson Place Subdivision, which easement is recorded in Volume 23, Page 90, be and the same is hereby closed for public use and every municipal purpose, subject to the property being replatted at applicant's expense, subject to the dedication of an additional 10 foot wide by 55 foot long area ae s drainage easement, and subject to the execution of a hold harmless agreement protecting the City against claims due to possible flooding of adjacent structure, as more fully set forth in the hold harmless agreement, a substantial copy of which 1s attached hereto and made a part hereof, marked Exhibit ,A,,. The above described triangularly shaped portion of the said 30 foot wide drainage easement Is hereby abandoned to the ow of the abutting property in accordancewith the laws of the State of Texas and for the service and interest of the inhabitants of the City of Corpus Christi, Texas. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. That upon wr tten request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need to close and abandon the abovementioned at the earliest practicable date, such finding of an emergency is made and declared requiring suspension of the Charter rule to consideration and voting upon ordinances or resolutions at three 18158 MICROFILMED 10 41.04 regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the nth day of March, 1985.
