AN ORDINANCE
CLOSING AND ABANDONING 50 F00T WIDE LENORA DRIVE FROM
MCARDLE ROAD TO MOUNT VERNON DRIVE AND APPROXIMATELY 260
FEET OF MOUNT VERNON DRIVE.
WHEREAS, notice of the time and place for holding a hearing concerning
the closing of 50 foot wide Lenora Drive from McArdle Road to Mount Vernon Drive
and approximately 260 feet of Mount Vernon Drive, was given by publication and
mailed to the last known addresses of the owners of property abutting the public
way and within 450 feet of the a a proposed to be closed, and thereafter,
pursuant to said notice, public hearing was held at Regular Council Meeting by
the City Council of the Caty of Corpus Christi on February 19, 1985, in
accordance with the provisions of the City Charter, and
WHEREAS, it was determined by the City Council after such hearing that
the aforesaid portion of right-of-way, proposed to be closed, is not needed now
nor will they be within the foreseeable future needed as public rights-of-way,
and that the same should revert to the abutting property owners, subject to
certain specified conditions•

NOW,I, TEXAS THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
SECTION 1. That there is hereby closed and abandoned 50 foot wide
Lenora Drive from McArdle Road to Mount Vernon Drive and approximately 260 feet
of Mount Vernon Drive, all in Mount Vernon No. 3 Subdivision, as shown by plat
n Volume 19, Pages 84, Map Records, Nueces County, Texas, and described by the
metes and bounds which are attached hereto and made a part hereof, marked
Exhibit "A".
SECTION 2. That this closure and abandonment is conditioned upon and
subject to street closure applicants Roy Smith and W. M. Bevly jointly and
severally performing the closure conditions set forth in Exhibit "B", attached
hereto, and incorporated herein by reference.

LENORA DRIVE CLOSURE CONDITIONS
(1) SNmdt construction plans showing the closing of the intersection of
Lenora Drive at mcArdle Road and physically close this intersection per
approved plans.
(7) 17:7appjorriate relocation costs for relocating 783 0070 gas line in
(3) Pay appropriate meter disconnect charges and other appropriate utility
cutoff charges in connection with the removal of homes from Lots 1
through 11, Block 10 and Lots 1 through 11, Block 9, Mount Vernon No. 3.
(4) Dedicate a 60 foot strip to the City ff. future street P0063 11074
the west boundary of King's Square, Got 71, as filed for record in
Volume 45, Pages 31 and 32, Map Records, Nueces County, Texas
(approximately 0.54 acres) within thirty (30) days of third reading of
this ordinance, and agree to pay the City the fair market value of the
difference between the Lenora/Mt. Vernon closure area (1.22 acres) and
the amount 027818842 3088 king's Square, Lot 78, which amount is
875,000. The payment of th. $75,000 will be made to the City prior to
the third reading of this ordinance being placed on the City Council
Agenda.
(5) Replat Gots 1 through 11, Block 10 and Lots 1 through 11, Block 9, Mount
Vernon No. 3.
(6) Agree to prohibit access from Mt. Vernon Drive to the replatted portions
of property abutting Lenora and Mt. Vernon Drive per this application.
(7) 211he.e. abutting properties on Lenora and mt. Vernon Drive per this
application are to be removed from Lots 1 through 11, Block 10 and
Gots 1 through 11, Block 9, Mount Vernon No. 3.
(8) Construct a barricade on Mt. Vernon Drive opposite the torsion lot line
of Lots 13 and 14, Block 9, Mount Vernon No. 3.
(9) Agree to remove all homes abutting properties on Janet Drive and the
portion of mt. Vernon Drive, wtach right-of-ways were closed by
Ordinance No. 17056 on May 26, 1982
(10) All of above conditions to be complied with within twenty (20) months of
date of this ordinance.
(11) All right-of-ways cloeed per this ordinance shall revert equally to
abetting property save and except the right-of-way closed in DM. Vernon
Drive, khich right-of-way shall revert totally to abutting prOPerty
along the east side of Mt. Vernon Drive owned by applicants.
(12) This ordinance shall be void and have no effect and ehall be
aetomatIcally repealed if any or all of the abOve conditions are not
complied with as herein provided
