HomeMy WebLinkAbout18775 ORD - 04/02/1985.124.01 AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF HAROLD KRONKE BY GRANTING A SPECIAL COUNCIL PERMIT FOR A 196 UNIT APARTMENT COMPLEX ON A PORTION OUT OF SURVEY 422, PEDRO 011000SA, ABSTRACT A-850, AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Harold Kronke, for amendment to thezoning map of the City of Corpus Christi, WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held an Tuesday, October 2, 1984, at regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi, and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS SECTION 1. That the Zoning Ordinance of the 0110 of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That a Special Council Permit be granted an a portion out of Survey 422, Pedro Hinolosa, Abstract A-850, situated in the City of Corpus Christi, Nueces County, Texas, and described by metes and bounds below, for a 196 unit apartment complex, according to the site plan, a copy of which 1s attached hereto and made a part hereof, marked Exhibit 282, and sublect to all other considerations of 20-11i" One -family Dwelling District. Metes and bounds description of a 13.6 acre tract filed in deed records, Volume 1755, Pages 687-692 of the Deed Records of Nueces County, Texas. Being a tract of land situated in Corpus Christi, Nueces County, Texas, between and adjacent 37 and Up River Road. Also, East of and ametes t to Carbon Plant Raed, more particularly described by metes and bounds as follows. BEGINNING at a point, the intersection of the East right-of-way line of Carbon Plant Road and the North right-of-way line of Up River Road for the Southwest corner of this tract; 18775 FAICROFILAI ED .124.01 THENCE N 08°57'57" E, along the East right-of-way line of said Carbon Plant Road, a distance of 263.62 feet to a concrete monument with a brass disc, for a Westerly corner ofthis tract, also being the Southwest corner of the South right-of-way line of said I.H. 37; THENCE N 39°50'23" E. along the South right-of-way line of said I.H. 37, a distance of 139.08 feet to a concrete monument (damaged) for a Northerly corner of this tract, THENCE S 59°49'35" E, continuing along the south right-of-way line of said I.N. 37, a distance of 441 88 feet for a Northerly corner of this tract, THENCE 5 57°03'34" E continuing along said South right-of-way line of I H. 37, a distance of 1221.51 feet to a 5/8 inch Iron rod for the Northeast cone r of this tract, also being the Northwest c of a 5.9 acre tract described in deed of record in Volume 1755, Pages 587-692 of the Deed Records of Nueces County, Texas, THENCE $ 32°56'26" W along the Westerly boundary line of said 5.9 acre tract, a distance of 402.95 feet to a 5/8 inch Iron rod set 1n the North right-of-way line of said Up River Road, for the Southeast corner of this tract, also being the Southwest corner of said 5.9 acre tract, THENCE N 55°18'42" W along the North right-of-way line of said Up River Road, a distance of 173.83 feet to an iron rod for a Southerly corner of this tract, THENCE N 39°50'42" W continuing along the North right-of-way line of said Up River Road, a distance of 408.33 feet to an iron rod for a Southerly corner of this tract, THENCE N 63°43'24" W, continuing along the North right-of-way line of said Up River Road, a distance of 1092.40 feet to the POINT OF BEGINNING. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified in this Special Permit, said Special Permit shall be void and of no force and effect whatsoever. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. 124.01 SECTION 5 That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6 That upon written request of the Mayor or five Council members. copy attached, to find and declare an emergency due to the need for efficient administration of City affairs bygranting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 2nd day of April, 1985.
