AN ORDINANCE
AMENDING ORDINANCE 13193, AS AMENDED BY ORDINANCE 18339 TO
ESTABLISH A NEN LEVEL OF SERVICE AND A NEN SCHEDULE OF RATES
FOR MONTHLY CABLE TELEVISION SERVICES BY ATHENA CABLEVI510N
OF CORPUS CHRISTI, INC.
WHEREAS, on January II, 1985, Athena Cablevision of Corpus Christi,
Inc (Athena) filed its request to establish a new level of service and for an
increase in basic cable television service ratespursuant to the rate revision
provision set forth in Section 23 of the franchise granted by the City Council
by Ordinance No 16133; and
WHEREAS, the Cable Communications Commission conducted a public
hearing pursuant to Section 28 of the franchise and made written recommendation
to the City Council prior to the Council's public hearing on Athena's request,
and
WHEREAS, the Cable Communications Commission held its public hearing
n February 25 and March 11, 1985, and filed its written recommendations to the
City Council, and
WHEREAS, an March 19, 1985, the City Council held its public hearing
n Athena's request pursuant to Section 23 of the franchise ordinance and
pursuant to Section 623 and Section 625 of the Cable Franchise Policy and
Communications Act of 1984; and
WHEREAS, at such hearing the City Council received and considered the
evidence and comments concerning Athena's investment in the system, Athena's
general financial condition, r the cast of rendering services, and other matters
relevant to a determination of proper rates. and
WHEREAS, the City Council finds that based upon clear and convincing
ntinCommunicationsevidence presented to the Cable Communications Commission at its public hearing
and the City Council at its public hearing that the monthly basic cable
television service rates charged by Athena Cablevision of Corpus Christi should
be increased as set forth herein.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS
Section 1. That the "Monthly Services Rate" portion of Section 1 of
Ordinance No. 13193, as amended by Ordinance No 18339, be and is hereby amended
to read as follows

* This rate shall become effective upon the finding by the Cable
Communications Commission that Athena has performed all of the
requirements set forth in the Attachment 3 of the Commission's
recommendation to the City Council dated March 14, 1985, but in no
event shall this rate be effective prior to danaury 1, 1986.
** The subscribers to this level of service
shall be charged up to
$250.00 on one-time basis. Personsdesiring to subscribe to
Optional Basic Service shall be promptly referred by Athena to the
City's Director of Public Utilities for further information on cable
television subscription rates
The Optional Basic Service level may be maintained by Athena so long
as the 1985 rates provided above are maintained throughout 1985 and
the basic service rate throughout 1986 for Regular Basic Service does
exceednot its

Section 2. That the remaining provisions 09 Ordinance 00. 03193, as
amended by Ordinance N0 18339, remain in effect.
Section 3. That nothing herein shall be construed to alter or amend
the provisions of Ordinance No. 16133 (Athena's Franchise Ordinance).
Section 4. That Athena pays the City 50% of the City's expenses

Section 5. If, for any re any section, paragraph, subdivision,
clause, phrase, word, or provision of this ordinance shall be held in invalid or
unconstitutional by final order of a court of competent ,jurisdiction, it shall
not effect any other section, paragraph, subdivision, clause, phrase, word, or
provision of this ordinance for it 1s the definite intent of this City Council
that every section, paragraph, subdivision, clause, phrase, word, or provision
hereof be given full force and effect for that purpose.
Section 6. Publication shall be made one time in the official
publication of the City of Corpus Christi, by publishing the caption of this
ordinance and the rate schedule set forth an Section 1 of this ordinance
