HomeMy WebLinkAbout18785 ORD - 04/09/1985AN ORDINANCE AUTHORIZING THE EXECUTION OF A CONTRACT WITH THE DEL MAR NEIGHBORH000 ASSOCIATION FOR THE LANDSCAPING OF A CERTAIN MEDIAN ON SANTA FE STREET, APPROPRIATING $5,200, AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager is hereby authorized to execute a contract with the Del Mar Neighborhood Association, which provides for the landscaping of a certain median on Santa Fe Street and the maintaining of said median by the Del Mar Neighborhood Association, all as more fully set forth to the contract, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. That there is hereby appropriated $5,200 from the Unrestricted Park Trust Fund. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need of executing the abovementioned contract at the earliest practicable date, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or olutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 9th day of April, 1985. WHEREAS, the Association is Interested in improving the aesthetic value of the "Santa Fe Triangle" within the Bel Mar Subdivision located in the City: and NOW, THEREFORE, the City and Association agree as follows: 1. The Association will make landscaping Improvements in the "Santa Fe Triangle" for and on behalf of the City. The improvements will be made in accordance with the plans and specifications approved by the Parks and Recreation Department. This Agreement shall be null and void should the landscaping Improvements not be carried out within six (6) months from the date of this Agreement or as set out in the approved plans and specifications or any change therein approved in writing by the Parks and Recreation Department. The Association agrees to pay the cost of installing an irrigation system in the "Santa Fe Triangle." The c nceptual plan for the landscaping is shown on the attached map marked as Exhibit "A." 2. The City agrees to contribute the cost of about (5,200 for the removal of the existing asphalt on the "Santa Fe Triangle," placement of fill material, installation of a water tap, and laying a concrete sidewalk. 3. The Association agrees to be responsible for the maintenance of the above-described landscaping in perpetuity and agrees to maintain such landscapingaccordance with directives from the Parks and Recreation Department 4. The Association agrees to indemnify the City against any claims arising a a resulof this prosect. 5. The Association further agrees, in compliance with City of Corpus Christi Ordinance No 17112, to complete, as part of this Agreement, the disclosure of Ownership Interests form attached hereto and labeled "EXHIBIT 8." 01.140.01 6. This Agreement shall become effective and shall be binding upon and shall inure to the benefit of the parties hereto and their respective heirs, successors and assigns from and after the date of execution.
