OPPOSING THE APPLICATION TO THE TEXAS DEPARTMENT OF WATER
RESOURCES FOR CLASS I, HAZARDOUS/COMMERCIAL INDUSTRIAL SOLID
WASTE STORAGE AND PROCESSING FACILITY PERMIT BY SDC
SERVICES, INC.; AND DECLARING AN EMERGENCY.
WHEREAS, a notice of public hearing on application for Class I,
Hazardous/Commercial Industrial Solid Waste Storage and Processing Facility
Permit was issued on February 22, 1985, by the Texas Department of Water
Resources regarding proposed permit No. HW -50059-001; and
WHEREAS, the location of the facility would be on Greenwood Drive near
the city limits of Corpus Christi and within one mile of existing and planned
residential subdivisions in Corpus Christi; and
WHEREAS, the applicant is SDC Services, Inc., who proposes to expand
the present facility to receive and process hazardous materials from Corpus
Christi refineries and nearby industrial plants:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the City. Council opposes the proposed expansion of
hazardous waste storage and processing by the SDC Services, Inc. near
residential developments.
SECTION 2. That the City Secretary be instructed to send a certified
copy of this resolution to Carl X. Forrester, Hearings Examiner, P.O. Box 13087,
Capitol Station, Austin, Texas 78711.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need of
efficient administration of City affairs, such finding of an emergency is made
and declared requiring suspension of the Charter rule as to consideration and
voting upon ordinances or resolutions at three regular meetings s0 that this
resolution is passed and shall take effect upon first reading as an emergency
measure this the 16th day of April, 1985.

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
