HomeMy WebLinkAbout18800 ORD - 04/23/1985TEXAS: AN ORDINANCE ANNULLING THE AWARD AND ACCEPTING THE FORFEITURE OF THE BID SECURITY OF THE LERMA COMPANY DUE TO FAILURE TO PROVIDE PERFORMANCE AND PAYMENT BONDS ON THE LOS ENCINOS PARK IMPROVEMENTS AND AUTHORIZING THE EXECUTION OF A CONTRACT WITH THE SECOND LOW BIDDER, FRATON, INC., FOR IMPROVEMENTS TO LOS ENCINOS PARK; APPROPRIATING $3,500; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the award of the contract to The Lerma Company for Los Encinos Park Improvements is hereby annulled and forfeiture of the bid security of The Lerma Company is hereby accepted due to failure to provide performance and payment bonds on the Los Encinos Park Improvements and authorizing the City Manager to execute a contract with the second low bidder, Fraton, Inc. for improvements to Los Encinos Park all as more fully set forth in plans and specifications and contract documents on file in the office of the City Secretary, all of which are made a part hereof by reference and according to the bid of Fraton, Inc., said bid being the lowest and most advantageous to the City of Corpus Christi. SECTION 2. That there is hereby appropriated $3,500 from the No. 162-152-807.08, Code 502, 10th Year Community Development Block Grant and utilizing previously authorized funds in the amount of $42,000 authorized by Ordinance No. 18733, passed on March 5, 1985. SECTION 3. That upon written request of the Mayor or five Council member's, copy attached, to find and declare an emergency due to the need to take immediate action to preserve and protect public property by expediting the construction of public improvements, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 23rd day of April, 1985.
