HomeMy WebLinkAbout18808 ORD - 04/30/19851.097.01 TEXAS: AN ORDINANCE AUTHORIZING THE CONVEYANCE BY SPECIAL WARRANTY DEED THE 35.289 ACRE TRACT OUT OF LOTS 9 AND 10, SECTION 21, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS, TO WAYNE LUNDQUIST, JR., TRUSTEE; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager is hereby authorized to convey by Special Warranty Deed the 35.289 acre tract out of Lots 9 and 10, Section 21, Flour Bluff and Encinal Farm and Garden Tracts to Wayne Lundquist, Jr., Trustee, for a cash consideration of $627,000, all as more fully set forth in the Special Warranty Deed, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need of executing the abovementioned Special Warranty Deed at the earliest practicable date, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 30th day of April, 1985. Page 1 of 3 Field notes for a 35.289 acre tract out of Lots 9 and 10, Section 21, Flour Bluff and Encinal Farm and Garden Tracts as shown by map of record in Volume A, pages 41, 42, 43, Map Records, Nueces County, Texas, and being that same tract of land described in Volume 252, Pages 69-70, Deed Records, Nueces County, Texas, said 35.289 acre tract being more particularly described by metes and bounds as follows: Beginning at a point in the centerline of 120 foot wide Rodd Field Road, at its intersection with the centerline of Airline Road, and being the northeast corner of said Lot 9; Thence N. 600 56' 00" W., with the northeast line of said Lot 9, a distance of 60.0 feet to a 1" iron pipe in the northwest right of way line of said Rodd Field Road for the northeast and beginning corner of the tract herein described; Thence 5. 29° 01' 30" W., with the northwest right of way line of said Rodd Field Road, a distance of 751.09 feet to a 1" iron pipe at the P.C. of a curve to the right for a corner of the tract herein described; Thence in a southwesterly direction with the arc of said curve to the right whose central angle is 90' 02' 00", whose radius is 513.20 feet, tangent distance of 513.50 feet, an arc distance of 806.31 feet to a 1" iron pipe, the point of tangency in the northeast right of way line of 120 foot wide Yorktown Road for a corner of the tract herein described; Thence N. 60° 56' 30" W., with the northeast right of way line of said Yorktown -Road, a distance of 746.65 feet to a 1" iron pipe in the northwest boundary line of said Lot 10, for the southwest corner of the tract herein described; Thence N. 29° 01' 30" E., with the northwest boundary line of said Lot 10, and generally with a wire fence, a distance of 1264.78 feet to a 1" iron pipe in the common corner of Lots 6,7, 10, and 11, said Section 21 for the northwest corner of the tract herein described; Thence S. 60° 56' 00" E., with the northeast boundary line of said Lots 10 and 9, a distance of 1260.15 feet to the point of beginning.
