HomeMy WebLinkAbout18818 ORD - 05/07/1985AN ORDINANCE AUTHORIZING THE EXECUTION OF AN INTERLOCAL COOPERATION ACT CONTRACT WITH THE STATE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION FOR THE PERFORMANCE OF A SKID TESTING PROGRAM; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager is hereby authorized to execute an Interlocal Cooperation Act Contract with the State Department of Highways and Public Transportation for the performance of a skid testing program to be conducted by the State on approximately 200 miles of city streets all as more fully set forth in the contract, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need of executing the abovementioned Interlocal Cooperation Act at the earliest practicable date, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 7th day of May, 1985. BRUCE AYK, CITY ATTORNEY By Assista" 02.050.01 ttorn MAYOR THE CI OF CORPUS CHRISTI, TEXAS 18818 MICROFIIMED INTERLOCAL COOPERATION ACT CONTRACT This Contract and Agreement is entered into by and between the State Agency and the Local Governmental Body shown below as Contracting Parties, pursuant to the authority granted and in compliance with the provisions of the "Interlocal Cooperation Act", Article 4413(32c)V.C.S. I. CONTRACTING PARTIES: The Receiving Party: City of Corpus Christi The Performing Party: State Dept. of Highways and Public Transportation II. STATEMENT OF SERVICES TO BE PERFORMED A. The "Performing Party" agrees to perform skid test operations on various streets within the city limits of City of Corpus Christi the "Receiving Party" (See Attachment 1 for tabulation of streets and mileage.) B. The "Receiving Party" agrees to: 1. Provide pre -engineering services and maps. 2. Provide administration from the Traffic and Transportation Department. 3. Provide police officers and supervisor for traffic control, as needed. 4. Utilize the skid test information to prioritize the street resurfacing program. 5. Continue the skid testing program to determine the wearing characteristics and friction characteristics of the various types of surface materials to predict high skid accident locations. 6. Complete computer forms showing project information. 7. Provide an observer to assist the Skid Test Operator. 8. Provide water for the Skid Test Operation. III. BASES FOR CALCULATING REIMBURSABLE COSTS: The Receiving Party will not be billed for costs incurred by the Performing Party. All costs incurred by the Performing Party will be the responsibility of the Performing Party and will be allocated from 402 Traffic Safety Funds. IV. TERM OF CONTRACT: This Contract is to begin upon approval and shall terminate September 30, 1985 4.J THE UNDERSIGNED CONTRACTING PARTIES do hereby certify that, (1) the services specified above are necessary and essential for activities that are properly within the statutory functions and programs of the affected parties of Local and State Government, (2) the proposed arrangements serve the interest of effi- cient and economical administration of Local and State Government, and (3) the services, supplies, or materials contracted for, if involving a State agency as one party to the contract, are not required by Section 21 of Article 16 of the Constitution of Texas to be supplied under contract given to the lowest responsible bidder. Receiving Party further certifies that it has the authority to contract for the above services by authority granted in Article 4413(32C) V.C.S. The Receiving Party is hereby authorized to perform work on this project during the period cited above, subject to the terms and conditions of this contract and all applicable state and federal laws and regulations.
