AMENDING CHAPTER 35, OIL AND GAS WELLS, SECTION 35-80,
INSURANCE AND BONDS. ANO SELTION 35-130(G)(1), WELLS TO BE
ABANDONED, TO PROVIDE THAT OIL AND GAS WELL OPERATORS MAY
POST IRREVOCABLE LETTERS OF CREDIT IN LIEU OF REQUIRED
BONDS, PROVIDING FOR SEVERANCE; AND PROVIDING FOR
PUBLICATION.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS.
SECTION I That Chapter 35 011 and Gas Wells, of the City Cade,
Section 35-80 Insurance and Bonds, is hereby amended by adding the following
paragraph between the fourth and tifth (last) paragraph
In lieu of the above described bond, a permittee may be
allowed to submit an irrevocable letter of credit, naming
the City as beneficiary, in face value equal to that of the
bond as described above. Drafts on such letter of credit
shall be issued based on statement in writing from the
Petroleum Superintendent, setting forth the circumstances
giving rise to the draft, and accompanied byproperly
drawn draft in an amount not to exceed the face value of the
letter of credit.
SECTION 2. That Chapter 35 Oil and Gas Wells, of the City Code,
Section 35-130, Wells to be Abandoned, Paragraph (G), subsection (1) is hereby
amended by continuing the second sentence of the first paragraph as follows.

drawn pursuant to the same conditions upon which the bond
would be predicated, based upon a statement in writing by
the Petroleum Superintendent setting forth the circumstances
giving rise to the draft and accompanied by a properlydrawn
draft in a p mount not to exceed the face value f the
letter of credit.
SECTION 3. If for any reason
any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final ,Judgment of a court of competent Jurisdiction, it
shall not affect any other section, paragraph, subdivision, clause, phrase, word
r provision of this ordinance for it Is the definite Intent of this City
Council that every section, paragraph, subdivision, clause,phrase, ward or
provision hereof be given full farce and effect for its purpose.
SECTION 4. Publication shall be made one time in the official
publication of the City of Corpus Christi by publishing the caption stating in
substance the purpose of the ordinance, this ordinance to become effective upon
such publication.
