AUTHORIZING THE EXECUTION OF A CONTRACT WITH OGLETREE,
BYRNE, WELSH 8 HUBNER ENGINEERING COMPANY PROVIDING FOR
ENGINEERING SERVICES FOR THE INSPECTION AND CONDITI011 SURVEY
OF THE SHORELINE DRIVE SEAWALL, APPROPRIATING 036,310, AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS.
SECTION 1. That the City Manager is hereby authorized to execute a
contract with Ogletree, Byrne, Welsh, and Hubner Engineering Company providing
for engineering services for the Inspection and Condition Survey of the
Shoreline Drive Seawall, all as e fully set forth in the contract, a
substantial copy of which i5 attached hereto and made a part hereof, marked
Exhibit "0".
SECTION 2. That there is hereby appropriated 036,310 from the
Reinvestment Zane Na. 1.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need of
executing the abovementioned contract at the earliest practicable date, such
finding of an emergency is made and declared requiring suspension of the Charter
rule as to consideration and voting upon ordinances or resolutions at three
regular meetings so that this ordinance is passed and shall take effect upon
first reading as an emergency measure this the 21st day of May, 1985.

The City of Corpus Christi, hereinafter called "City" and Ogletree,
Byrne, Welsh S. Hubner Engineering Company, hereinafter called "Engineer",
agree as foliows
I SERVICES TO BE PERFORMED
The Engineer hereby agrees at his ows expen a to perform an inspection

and condition survey of the seawall from the ArtMuseum of South Texas to
Holiday Inn - Emerald Beach and prepare an engineering report outlining
specific maintenance and repair requirements and estimated costs of this work.
11 SCOPE OF SERVICES
The scope of services for this project, for which the Engineer agrees
to perform professionals services, is as follows:
1 Stationing along the s awall far location reference of all inspection
information. Elevation Reference Datum will be Mean Sea Level and tied
to the City bench marks in the seawall vicinity.
2 Soundings along the face of the s awall and along a line 15 feet
seaward of the seawall. Intervals of sounding along the face of the
wall will be at 40 feet typically. The intervals will be reduced to 10
feet or less In areas where abrupt bottom changes are anticipated or
discovered.
Underwater inspection of the outside face of the seawall from the
mudlone up will be a "Level I - General Inspection" as described III
Attachment "A" of this proposal Areas of distress in the steel sheet
poling and the cap sections will be located relative to the stations
established. At each of the storm drain outfall structures, a more
detailed Inspection will be made. Bottom conditions will be checked by
probing the bottom to a depth of four feet m The purpose will
be to locate any horizon of flan bottom material rounder the soft slit
deposit.
"Level II" Inspections, as described in Attachment "A", moll be
conducted ats ix locations where oresevere o s 5 c
lly trated
conditions ofdeterioration are found. Voidsbehindthe bulkhead I
the vicinity of corrosion penetrations will be probed at these
locations to provide estimates of size and extent of material loss.
"Level III" Inspections, as described in Attachment "A" will be
conducted at the same six locations at which the Level II inspections
are made. Excavations will be made to provide access for inspection of
the sheet pile fora depth of two feet below the present mudline.

An engineering report will be prepared with narrative description and
appropriate illustrations of conditions found. The torn f report
presentation will be coordinated to permit synthesis of this report and
reports on ther elements Of the marina complex into budget and
maintenance planning. This report hall include cost estimates f the
recommended me ance and repair wr k. (he Engineer shall be
required to submit twenty (20) copies ofthe Engineering Report prior
to completion of the prodect
111 CITY FURNISHED ITEMS
City agrees to turnish Engineer any plans or studies currently ,n City
files for use n this project. Such materials are to be reproduced at the
expense of the Eng v In the event the City provides original orone of a
kind drawings and/or reports tothe Engineer, such materials areto be
returned to the City before final payment of fees.
IV. TRANSFER OF INTEREST
The Engineer shall not assign or transfer any interest in this contract
without prior written consent from the L,ty
V 0000X1.0 RENDERING OF SERVICES
The tng,neer shall furnish the items required herein within sixty (60)
calendar days of date of letter of authorization to proceed
VI INSURANCE REQUIREMENTS
The Engineer shall provide insurances for their staff and equipment of
the types and amounts as follows.
1. Workmen's Compensation with atutory 110, is aolud,ng Federal
Longshoremen's and Labor Worker's Compensation Act whenever applicable.
2. Comprehensive General Liability - limits for bodily injury and property
damage in the amount of $500,000 Combined Single Limit. (Property
damage includes explosion, collapse, underground hazards ) Water craft
exclusion shall be deleted when floating equipment and/or crafts are
used ,n the work.
Automobile Liability - $500,000 per occurrence, Combined Single Limit.
In addition to the above underlying limits, Engineer will provide a
additional $1,000,000 umbrella policy overall underlying limits stated
above.
She Engineer will provide Certificates of Insurance naming the City as
additional insured for the work to be done under this contract.
VI. INDEMNIFICATION AND HOLO HARMLESS

losses and expenses, including consultant's fees. expert witness fees, court
costs and attorneystees, for or on account ot any injury to any person, or
death at any time resulting from such injury, or any damage to property, which
may arise or which may be alleged to have arisen out or Engineer's acts or
omissions, whether intentional or negligent, in performing its services under
this contract. Engineer shall not be responsible for any damages. whether
special, indirect, incidental or consequential, arising outside the scope at
Engineer's services under this contract or beyond its control.
VIII. COMPENSATION
The City agrees to pay the Engineer tor his services related to this
contract a fee or Thirty-six Thousand, Three Hundred Ten Dollars ($36,310.00).
Said tee shall be paid upon acceptance of the Engineering Report by the City.
IX CON1RACT TERMINATION
The City reserves the right to terminate this contract at any time,
with or without cause. In the event of such termination, the Engineer will be
paid a sum proportionate to the state ot completion of the phase or work in
which he is then engaged.

WATER DEPTH SOUNDING
Soundings along the face of the seawall will be taken
wIth a sounding tape and a standard "soft bottom.
sounding weIght. Where water depths axe 6 ft. or less,
soundIngs wIll be made using a pole with a tape
attached. Readings wall be corrected to Mean Sea Level
ElevatIon Datum.
B. Soundings aTong a lane 15 ft. seaward of the face of
the wall wall be made from a boat, usong a Ratheon DE
719B Recording fathometer. Sounding wall be continuous
and Indexed to stations marked on the seawall.
3. BOTTOM PROBING
Bottom materaal consastancy and any form bottom horizon wall
be estImated by resastance to probang of the bottom to a
depth of four feet or to a farm horason. The probe will be
a smooth 3/8. rod.
