HomeMy WebLinkAbout18846 ORD - 05/21/1985AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT TO THE CONTRACT FOR COLLECTION OF TAXES BETWEEN THE CORPUS CHRISTI INDEPENDENT SCHOOL DISTRICT AND CORPUS CHRISTI .JUNIOR COLLEGE DISTRICT ORIGINALLY ENTERED ON THE 18TH DAY OF NOVEMBER, 1959, AND RENEWED FROM TIME TO TIME 50 AS TO AUTHORIZE THE CITY OF CORPUS CHRISTI TO CONTRACT WITH AN ATTORNEY PURSUANT TO SECTION 6 30, PROPERTY TAX CODE TO ACT FOR AND ON BEHALF OF ALL TAXING JURISDICTIONS; AND DECLARING AN EMERGENCY. WHEREAS, the City of Corpus Christi and Corpus Christi Independent School District and Corpus Christi Junior College District entered into a agreement for collection of ad valorem taxes on or about the 16th day of November, 1959; and WHEREAS, the Property Tax Code authorizes taxing authorities including the City of Corpus Christi, Corpus Christi Independent School District, and Corpus Christi Junior College District to contract with private attorneys for delinquent tax collection, and WHEREAS, the parties hereto are desirous of having the City of Corpus Christi enter into such contract for and on behalf of the parties hereto; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. The City Manager is hereby authorized to execute a amendment to the heretofore existing agreement for collecting taxes between the City of Carpus Christi and Corpus Christi Independent School District and Corpus Christi Junior College District so as to authorize the City of Corpus Christi to contract with a attorney for the collection of taxes pursuant to Section 6 30, Texas Property Tax Code. SECTION 2 That upon written request of the Mayor or five Council members, copy attached, to find and declare an mergency due to the need for immediate a ecution of the aforementioned amendment so as to permit continuity of the said contract, such finding of an emergency is made and declared requiring suspension of the Charter rule as to c nsideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 21st day of May, 1985. The agreement heretofore existing between the City of Corpus Christi and Carpus Christi Junior College District first entered an r about the 18th day of November, 1959, and amended and extended from time to time is hereby amended by adding the following at the end of the paragraph XII• °Notwithstanding the foregoing, as ail alternative, the City of Corpus Christi, for and on behalf of the parties hereto, may enter into a contract with anattorney pursuant to the provisions of Section 6.30, Texas Property Tax Code°.
