AN ORDINANCE
ACCEPTING THE CONTRACT WITH F & E ERECTION COMPANY, INC. FOR
IMPROVEMENTS TO THE OSO WASTEWATER TREATMENT PLANT
CONTRACT 5 AND AUTHORIZING FINAL PAYMENT IN THE AMOUNT OF
$217,305.15; GRANTING THE CONTRACTOR A 103 -DAY EXTENSION TO
THE CONTRACT PERIOD; APPROPRIATING $45,000 OUT OF THE
NO. 250 SANITARY SEWER BOND FUND FOR FINAL PAYMENT TO THE
CONTRACTOR AND ENGINEER AND FOR RELATED EXPENSES; AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That the contract with F & E Erection Company, Inc. for
improvements to the Oso Wastewater Treatment Plant Contract is hereby accepted
and that final payment in the amount of $217,305.15 is authorized.
SECTION 2. That the contractor is hereby granted a 103 -day extension
to the contract period.
SECTION 3. There is hereby appropriated $45,000 out of the No. 250
Sanitary Sewer Bond Fund for final payment to the contractor and engineer and
for related expenses.
SECTION 4. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need to
appropriate the abovementioned funds at the earliest practicable date, such
finding of an emergency is made and declared requiring suspension of the Charter
rule as to consideration and voting upon ordinances or resolutions at three
regular meetings so that this ordinance is passed and shall take effect upon
first reading as an emergency measure this the 28th day of May, 1985.

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
