HomeMy WebLinkAbout18853 ORD - 05/28/1985• AN ORDINANCE AUTHORIZING THE EXECUTION OF AN ESCROW AGREEMENT WITH THE STATE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION FOR THE CITY'S SHARE OF EQUIPMENT AND MATERIAL COSTS NECESSARY FOR THE INSTALLATION OF SIGNALIZATION IMPROVEMENT AT SEVEN INTERSECTIONS CITY WIDE; APPROPRIATING $11,080 AND UTILIZING PREVIOUSLY APPROPRIATED FUNDING OF $19,962; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager is hereby authorized to execute an escrow agreement with the State Department of Highways and Public Transportation providing for the City's share of equipment and material costs necessary for the installation of signalization improvement at seven (7) intersections City wide, all as more fully set forth in the contract, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. That there is hereby appropriated $11,080 from the No. 220 Street Bond Fund and utilizing previously appropriated funding in the amount of $19,962 from the No. 162-152-807.08, Code 502, Tenth Year Community Development Block Grant authorized by Ordinance No. 18232 on May 16, 1984. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need of executing the abovementioned escrow agreement at the earliest practicable date, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 28th day of May, 1985. WHEREAS, the City desires the construction of modernization of existing traffic signals and incidental items at Ayers with Gollihar on Metropolitan Highway No. 12, Port Ave. with Tarlton Street and Port Ave. with Morgan on Metropolitan Highway No. 102, Staples Street with Williams on Metropolitan Highway No. 29, Staples Street with Elizabeth on Metropolitan Highway No. 374, Airline Road with McArdle on Metropolitan Highway No. 1443 and Everhart with Corona Street on Metropolitan Highway No. 410. The City has requested the State to construct or have constructed this work. The State will construct or have constructed this work and the City will pay ten per cent (10%) of the construction cost of this work or that portion not reimbursable by the Federal Government. The estimated construction cost of this work, excluding preliminary engineering, is Three Hundred Ten Thousand Four Hundred Twenty and No/100 Dollars ($310,420.00), and the City's estimated ten per cent (10%) share is Thirty One Thousand Forty Two and No/100 Dollars ($31,042.00). NOW THEREFORE, it is understood that this proposed work will be constructed by the State and the City will transmit to the State with the return of this agreement, executed by the City, a warrant or check made payable to the State Treasurer, Account of Trust Fund No. 927 in the amount of Thirty One Thousand Forty Two and No/100 Dollars ($31,042.00), to be used in paying for the proposed work required by the City in the City of Corpus Christi. It is further understood that the State will -1- I)" • • construct only those items for the City as requested and required by the City and ten per cent (10%) of the construction cost of such items or that portion not reimbursable by the Federal Government will be borne by the City. If upon completion of construction, at receipt of bids, or at anytime, it is found that the amount previously collected is insufficient to pay the City's portion, then the City upon request of the State will forthwith supplement this amount by an amount equal to the City's actual share of the cost of this work less the amount previously paid into Trust Fund No. 927. In the event the amount as paid is more than the actual cost, then the excess amount will be returned to the City. It is further understood that the work to be done on behalf of the City, as herein provided, will include the cost of contingencies and construction engineering.
