AN ORDINANCE
AMENDING THE ZONING ORDINANCE UPON APPLICATION OF EXXON
CORPORATION BY GRANTING A SPECIAL COUNCIL PERMIT FOR A
SERVICE STATION WITH NEW STANDARD SCREENING FENCE ALONG THE
PROPERTY LINE AND 60 FEET WEST OF THE WEST RIGHT-OF-WAY LINE
OF TOPEKA STREET, SUCH AREA TO HAVE GRASS, PLANTS AND AN
UNDERGROUND IRRIGATION SYSTEM INSTALLED AND MAINTAINED AS A
GREEN BUFFER AREA ON A PORTION OUT OF LOTS 4 AND 5, AND ALL
OF LOTS 1-3, BLOCK 817, PORT ARANSAS CLIFFS; AND DECLARING
AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council its
reports and recommendations concerning the application of Exxon Corporation, for
amendment to the zoning map of the City of Corpus Christi;
WHEREAS, public hearing was held at which hearing all persons wishing
to appear and be heard were heard, to consider the same before the City Council
of the City of Corpus Christi, in accordance with proper notice to the public,
said public hearing having been held on Tuesday, May 7, 1985, at Regular Council
meeting of the City Council in the Council Chamber at City Hall in the City of
Corpus Christi; and
WHEREAS, by motion duly made, seconded and carried, it was decided by
the City Council that to approve the hereinafter set forth amendment would best
serve public health, necessity and convenience and the general welfare of the
City of Corpus Christi and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus Christi,
Texas, is amended by making the change hereinafter set out.
SECTION 2. That a Special Council Permit be granted on a portion of
Lots 4 and 5, and all of Lots 1-3, Block 817, Port Aransas Cliffs, situated in
the City of Corpus Christi, Nueces County, Texas, and further described by metes
and bounds below, for a service station with a new standard screening fence
along the property line and 60 feet west of the west right-of-way line of Topeka
Street, such area to have grass, plants and an underground irrigation system
installed and maintained as a green buffer area, according to the site plan, a
copy of which is attached hereto and made a part hereof, marked Exhibit "A", and
subject to all other considerations of "R -1B" One -family Dwelling District and
"R -1B" One -family Dwelling District with a "SP" Special Permit:
Being a tract situated in Corpus Christi, Nueces County,
Texas consisting of Lots 1-3 and a portion of Lots 4 and 5,
Block 817, Port Aransas Cliffs a subdivsiion of the City of
Corpus Christi as shown on the map recorded in Volume 4 at
02.112.01

Page 51 of the Map Records of Nueces County, Texas and being
more particularly described by metes and bounds as follows:
BEGINNING at the east corner of Lot 1, Block 817, Port
Aransas Cliffs, the intersection of the northwest
right-of-way of Doddridge Street with the southwest
right-of-way of Topeka Street for the east corner of this
tract;
THENCE S 58°54' W along the southeast line of Lot 1,
Block 817 and the northwest right-of-way of Doddridge Street
a distance of 125.0 feet to the south corner of Lot 1 for
the south corner of this tract;
THENCE N 31°06' W along the southwest line of Lots 1, 2, 3,
4, and 5, a distance of 118.5 feet to a point in the
southwest line of Lot 5 for the west corner of this tract;
THENCE N 58°54' E across Lot 5 a distance of 47.0 feet to a
point for the most westerly north corner of this tract;
THENCE S 31°06' E at 18.5 feet cross the southeast line of
Lot 5 and the northwest line of Lot 4, and in all a distance
of 20.0 feet to a point for an interior corner of this
tract;
THENCE N 58°54' E, 1.5 feet southeast of and parallel to the
northwest line of Lot 4 a distance of 78.0 feet to a point
in the northeast line of Lot 4 and southwest right-of-way of
Topeka Street for the most easterly north corner of this
tract;
THENCE S 31°06' E along the southwest right-of-way of Topeka
Street and the northeast line of Lots 4, 3, 2, and 1 a
distance of 98.5 feet to the Point of Beginning forming a
tract embracing 13,252.50 square feet (0.3042 acres).
In the event the Board of Adjustment grants any special exception or
variance to the Zoning Ordinance, applicable to the Special Permit herein
granted, other than the one specified in this Special Permit, said Special
Permit shall be void and of no force and effect whatsoever.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1973, as amended from time
to time, except as herein changed, shall remain in full force and effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.

SECTION 6. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by granting the aforesaid zoning
change, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances
or resolutions at three regular meetings so that this ordinance is passed and
shall take effect upon first reading as an emergency measure this the 28th day
of May, 1985.

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
