AN ORDINANCE
AMENDING THE ZONING ORDINANCE UPON APPLICATION OF R. C.
ALLEN AND TIM CLOWER BY GRANTING A SPECIAL COUNCIL PERMIT
FOR A PARKING LOT ON A PORTION OUT OF LOT 1, SECTION 5,
BOHEMIAN COLONY LANDS; AND DECLARING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council its
reports and recommendations concerning the application of R. C. Allen and Tim
Clower, for amendment to the zoning map of the City of Corpus Christi;
WHEREAS, public hearing was held at which hearing all persons wishing
to appear and be heard were heard, to consider the same before the City Council
of the City of Corpus Christi, in accordance with proper notice to the public,
said public hearing having been held on Tuesday, May 28, 1985, at Regular
Council meeting of the City Council in the Council Chamber at City Hall in the
City of Corpus Christi; and
WHEREAS, by motion duly made, seconded and carried, it was decided by
the City Council that to approve the hereinafter set forth amendment would best
serve public health, necessity and convenience and the general welfare of the
City of Corpus Christi and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus Christi,
Texas, is amended by making the change hereinafter set out.
SECTION 2. That a Special Council Permit be granted on a portion of
Lot 1, Section 5, Bohemian_ Colony Lands, situated in the City of Corpus Christi,
Nueces County, Texas, and further described by metes and bounds description
below, for a parking lot with no curb cuts on Trojan Drive and a six foot
standard screening fence, according to the site plan, a copy of which is
attached hereto and made a part hereof, marked Exhibit "A", and subject to all
other considerations of "A-1" Apartment House District:
Fieldnotes for a 2.127 acre tract of land out of Lot 1,
Section 5, Bohemian Colony Lands as shown by map of record
in Volume A, Page 48, Map Records, Nueces County, Texas:
Beginning at a 2 inch iron pipe filled with concrete set on
the South boundary line of Trojan Drive (60.00 feet wide)
for the Northeast corner of this survey from which corner
the Northeast corner of Lot 1, Block 1, Greenwood Terrace,
as recorded in Volume 39, Page 135, said map records, bears
S 28°57'15" W 137.73 feet, S 61°33'30" E 200.00 feet,
S 29°02'50" W 458.00 feet;

Thence, leaving said South boundary line, S 28°57'15" W
101.12 feet to a point for the Southeast corner of this
survey and the point of curvature of a circular curve to the
left whose radius point bears S 38°12'36" W 578.33 feet and
which has a central angle of 09°46'06", a radius of 578.33
feet, a tangent distance of 49.42 feet, and an arc length of
98.60 feet;
Thence, along said circular curve to the left, 98.60 feet to
the point of tangency;
Thence, N 61°33'30" W 831.85 feet to a point on the East
line of a 100.00 foot wide drainage ditch, for the Southwest
corner of this survey'
Thence along said East line, N 28°36'45" E 90.03 feet to a
drill hole set for the Northwest corner of this survey;
Thence leaving said East line, S 61°33'30" E 38.00 feet to a
2 inch iron pipe filled with concrete set for the point of
curvature of a circular curve to the right whose radius
point bears S 61°23'15" E 10.00 feet and which has a central
angle of 89049'45", a radius of 10.00 feet, a tangent
distance of 9.97 feet, and an arc length of 15.68 feet;
Thence along said circular curve to the right, 15.68 feet to
a 2 inch iron pipe filled with concrete set for the point of
tangency;
THENCE. S 61°33'30" E along the South boundary line of
Trojan Drive 783.58 feet to a 2 inch iron pipe filled with
concrete for the point of curvature of a circular curve to
the right whose radius point bears S 28°26'30" W 678.33 feet
and which has a central angle of 08°23'40", a radius of
678.33 feet, a tangent of 49.78 feet, and an arc length of
99.38 feet;
Thence, along said circular curve to the left, 99.38 feet to
the Point of Beginning.
In the event the Board of Adjustment grants any special exception or
variance to the Zoning Ordinance, applicable to the Special Permit herein
granted, other than the one specified in this Special Permit, said Special
Permit shall be void and of no force and effect whatsoever.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1973, as amended from time
to time, except as herein changed, shall remain in full force and effect.

SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by granting the aforesaid zoning
change, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances
or resolutions at three regular meetings so that this ordinance is passed and
shall take effect upon first reading as an emergency measure this the 28th day
of May, 1985.

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
