HomeMy WebLinkAbout18883 ORD - 06/18/1985TEXAS: AN ORDINANCE AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH SOUTH BLUFF PLAZA PARTNERSHIP FOR THE TOTAL RECONSTRUCTION OF THE APPROXIMATE 250 FOOT LONG PARK ROAD ALONG THE NORTH SIDE OF BLUCHER PARK; APPROPRIATING $5,000; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager is hereby authorized to execute an agreement with South Bluff Plaza Partnership for the total reconstruction of the approximate 250 foot long park road along the north side of Blucher Park, all as more fully set forth in the contract, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. That there is hereby appropriated $5,000 from the No. 111-000-241.01-000 Unrestricted Park Trust Fund. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need of executing the abovementioned agreement at the earliest practicable date, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 18th day of June, 1985. Martin, and South Bluff Plaza Partnership, hereinafter called "Developer", said Agreement pertaining to the reconstruction of Carrizo Street and a park road along the north side of South Bluff Park. WHEREAS, the Developer has under construction a two-story office building on Carrizo Street at its dead end with South Bluff Park and desires to improve the right-of-way and the park road at South Bluff Park, and WHEREAS, the City is agreeable to the reconstruction and upgrading of the park road at South Bluff Park, and WHEREAS, the City and Developer agree to certain obligations pertaining to the reconstruction of Carrizo Street and said park road, all as shown on attached Exhibit "A"; NOW, THEREFORE, City and Developer agree as follows: 1. City will prepare necessary plans and specifications, advertise for and receive bids, award a construction contract and provide staking and inspection services, all at City cost. 2. The City estimates the cost of construction of this project as being $35,000. Developer agrees to pay city his cost of construction, estimated to be $30,000 for the project, prior to the award of a contract. City agrees to pay the cost of curb and gutter along the south side of the Park Road and any storm sewer work, with the estimated City cost being $5,000. Actual costs will be determined by bids received, with both City and Developer having the right to renegotiate after bids are received. The cost of driveways to serve Developer in Carrizo Street are in addition to Developer's estimated costs indicated herein and said costs are exclusive of any post bid cost negotiations by both parties. 3. City will prepare proposal for all work based on the unit price concept so that all prices can readily be determined. 4. City will assume the cost of necessary quality control testing on the project as well as any required utility adjustments or lowering. 5. City recognizes that time is of the essence and will endeavor to have street construction begin on Carrizo Street and the park road no later than 03P.039.01 • the first week of September, 1985, with street construction, assuming good weather, expected to be complete within six weeks of such beginning date. 19 ATTEST: EXECUTED IN DUPLICATE originals this day of CITY OF CORPUS CHRISTI By: City Secretary Edward A.
