CLOSING AND ABANDONING THE 10 FOOT WIDE UTILITY EASEMENT IN
BLOCK 10, MT. VERNON SUBDIVISION, UNIT 3, AND THE 15 FOOT
WIDE UTILITY AND DRAINAGE EASEMENT IN LOT B2, MT. VERNON
SUBDIVISION, UNIT 1, SUBJECT TO THE PROVISIONS LISTED BELOW;
AND DECLARING AN EMERGENCY.
WHEREAS, there exists the 10 foot wide utility easement in Block 10,
Mt. Vernon Subdivision, Unit 3, recorded in Volume 19, Page 84, Map Records of
Nueces County, Texas, and the 15 foot utility and drainage easement in Lot B2,
Mt. Vernon Subdivision, Unit 1, recorded in Volume 50, Page 113, Map Records,
Nueces County, Texas; and
WHEREAS, it has been determined that it is feasible and advantageous
to the City of Corpus Christi to abandon said easement, subject to the
provisions listed below:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the 10 foot wide utility easement in Block 10, Mt.
Vernon Subdivision, Unit 3, as recorded in Volume 19, Page 84, Map Records,
Nueces County, Texas, and the 15 foot utility and drainage easement in Lot 62,
Mt. Vernon Subdivision, Unit 1, recorded in Volume 50, Page 113, Map Records,
Nueces County, Texas, both more particularly described by attached metes and
bounds descriptions, be and the same is hereby closed for public use and every
municipal purpose, subject to the relocation of all existing utilities at
applicant's expense and dedications of new easements as required for said
relocations, and subject to the property being replatted at applicant's expense.
The above described utility easement is hereby abandoned to the owners of the
abutting property in accordance with the laws of the State of Texas, and for the
service and interest of the inhabitants of the City of Corpus Christi, Texas.
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction, it
shall not affect any other section, paragraph, subdivision, clause, phrase, word
or provision of this ordinance, for it is the definite intent of this City
Council that every section, paragraph, subdivision, clause, phrase, word or
provision hereof be given full force and effect for its purpose.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need to
close and abandon the abovementioned utility and drainage easements at the
earliest practicable date, such finding of an emergency is made and declared
requiring suspension of the Charter rule as to consideration and voting upon
ordinances or resolutions at three regular meetings so that this ordinance is

drainage easement out of Lot B-2, Mount•Vernon Subdivision Unit No. 1 a map
of which is recorded in Volume 50, Page 113 Map Records of Nueces County, Teras:
BEGINNING at a 5/8 inch iron rod set for the East corner of said Lot B-2
for the Northeast corner of this easement;
THENCE South 29°02'30" West with the Southeast boundary line of Lot B-2,
15.00 feet for the Southeast corner of this easement;
THENCE North 60°57'30" West leaving the abovementioned Southeast line,
325.00 feet for the Southwest corner of this easement;
THENCE North 29°02'30" East 15.00 feet to a point on the Northeast boundary
line of said Lot B-2 for the Northwest corner of this easement;
THENCE South 60°57'30" East with the abovementioned Northeast line, 325.00
feet to the "Point of Beginning".

Vernon Subdivision Unit 3, a map of which is recorded in Volume 19, Page 84, Map Records of
Nueces County, Texas;
BEGINNING at a point on the North boundary line of a 50.00 foot wide street (Mt. Vernon
Drive) closed by City of Corpus Christi ordinance number 17056 for the Southeast corner of this
easement, from which corner the Southeast subdivision corner of Unit 3 beers South 29°00'30"
West 50.00 feet, thence South 60°57'30" East 277.00 feet;
THENCE North 60°57'30" West along said North boundary line, 10.00 feet for the
Northwest corner of this easement;
THENCE, leaving said North line, North 29°0010" East 30.80 fat for the point of
curvature of a circular curve to the right whose radius point bears South 60°59'30" East 3634.83
fat and which has a central angle of 05°51'00", a radius of 3634.83 fat, a tangent distance of
185.72 fat and en arc length of 371.12 fat;
THENCE, with said circualr curve to the right, 371.12 feet for the point of reverse
curvature of a circular curve to the left whose radius point bears North 55°08'30" West 3060.83
feet and which hes a central angle of 05°51'00", a radius of 3060.83 fat, a tangent distance of
156.39 feet and an arc length of 312.52 feet;
THENCE, with said circular curve to the left, 312.52 fat for the point of tangency;
THENCE North 29°00'30" East 30.00 feet to a point on the South boundary line of McArdle
Road, as shown on the recorded map of said Mt. Vernon Subdivision Unit 3, for the Northeast corner
of this easement;
THENCE South 60°59'30" East, parallel to the centerline of McArdle Road thereof end 25.00
fat distant therefrom, measured at right angles thereto, 10.00 feet for the Southeast corner of this
easement;
THENCE, leaving said South line of McArdle Road, South 29°00'30" West 30.00 feet for the
point of curvature of a circular curve to the right whose radius point bears North 60°59'30" West
3070.63 feet end which has a central angle of 05°51'00", a radius of 3070.83 feet, a tangent ;
distance of 156.91 feet and an arc length of 313.54 fat;

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
