HomeMy WebLinkAbout18894 ORD - 06/25/1985• AN ORDINANCE AUTHORIZING THE EXECUTION OF AN ESCROW AGREEMENT WITH THE STATE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION FOR THE CITY'S SHARE OF EQUIPMENT AND MATERIAL COSTS NECESSARY FOR THE INSTALLATION OF SIGNALIZATION IMPROVEMENTS AT FIVE INTERSECTIONS CITY-WIDE; APPROPRIATING $23,090.50; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager is hereby authorized to execute an escrow agreement with the State Department of Highways and Public Transportation for the City's share of equipment and material costs necessary for the installation of signalization improvements at five (5) intersections City-wide, all as more fully set forth in the escrow agreement, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. That there is hereby appropriated $23,090.50 from the No. 220 Street Bond Fund. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need of executing the abovementioned escrow agreement at the earliest practicable date, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 25th day of June, 1985. WHEREAS, the City desires the construction of modernization of existing traffic signals and incidental items at Baldwin with .Greenwood on Metropolitan Highway No. 408, Staples with Holly Road and Staples with Wooldridge on Metropolitan Highway No. 29, McArdle Road with Kostoryz on Metropolitan Highway No. 103 and Alameda with Doddridge on Metropolitan Highway No. 373. The City has requested the State to construct or have constructed this work. The State will construct or have constructed this work and the City will pay ten per cent (10%) of the construction cost of this work or that portion not reimbursable by the Federal Government. The estimated construction cost of this work, excluding preliminary engineering, is Two Hundred Thirty Thousand Nine Hundred Five and No/100 Dollars ($230,905.00), and the City's estimated ten per cent (10%) share is Twenty Three Thousand Ninety and 50/100 Dollars ($23,090.50). NOW THEREFORE, it is understood that this proposed work will be constructed by the State and the City will transmit to the State with the return of this agreement, executed by the City, a warrant or check made payable to the State Department of Highways and Public Transportation in the amount of Twenty Three Thousand Ninety and 50/100 Dollars ($23,090.50), to be used in paying for the proposed work required by the City in the City of Corpus Christi. It is further understood that the State will -1- 1 1) • • construct only those items for the City as requested and required by the City and ten per cent (10%) of the construction cost of such items or that portion not reimbursable by the Federal Government will be borne by the City. If upon completion of construction, at receipt of bids, or at anytime, it is found that the amount previously collected is insufficient to pay the City's portion, then the City upon request of the State will forthwith supplement this amount by an amount equal to the City's actual share of the cost of this work less the amount previously paid to the State Department of Highways and Public Transportation. In the event the amount as paid is more than the actual cost, then the excess amount will be returned to the City. It is further understood that the work to be done on behalf of the City, as herein provided, will include the cost of contingencies and constructiqn engineering.
