AMENDING MOTION M84-1125 BY REDUCING THE $25,000 ALLOCATED
TO PERMANENT ART TRUST FUND TO $17,500 AND APPROPRIATING
RESULTING $7,500 FOR CONTRACT TO THE TEXAS JAll FESTIVAL
SOCIETY FOR THE TEXAS JAll FESTIVAL; AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That Motion M84-1125 allocating $25,000 to the Permanent
Art Trust Fund is hereby amended by reducing such allocation to $17,500.
SECTION 2. That the resulting $7,500 in the 1984-85 Tourist and
Convention Development Fund is appropriated to fund the 1985 contract with the
Texas Jazz Festival Society for the Texas Jazz Festival. The $7,500 must be
reimbursed before any other Texas Jazz Festivals are funded by the City.
SECTION 3. That the City Manager is hereby authorized to execute an
agreement with Texas Jazz Festival Society for the 1985 Texas Jazz Festival, all
as more fully set forth in the contract, a substantial copy of which is attached
hereto and made a part hereof, marked Exhibit "A".
SECTION 4. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need of
executing the agreement and appropriating the fund as aforementioned at the
earliest practicable date, such finding of an emergency is made and declared
requiring suspension of the Charter rule as to consideration and voting upon
ordinances or resolutions at three regular meetings so that this ordinance is
passed and shall take effect upon first reading as an emergency measure this the
25th day of June, 1985.

KNOW ALL BY THESE PRESENTS:
This Agreement by and between the City of Corpus Christi, Texas
(hereinafter "City") and the Texas Jazz Festival Society (hereinafter
"Contractor");
WITNESSETH:
WHEREAS, the City of Corpus Christi is interested in bringing to its
citizens a major State Jazz Festival; and
WHEREAS, the Texas- Jazz Festival Society has a program of providing
such an activity to the public. and
WHEREAS, the City of Corpus Christi finds that this Texas Jazz
Festival is in the public interest;
NOW, THEREFORE, the City and the Contractor in consideration of the
premises, covenants, and conditions herein expressed mutually agree as
follows:
I.
The Contractor agrees to provide the 25th Annual Texas Jazz Festival
in Memorial Coliseum, to the public on Sunday, July 14, 1985. The
Contractor may use the Memorial Coliseum facility for this purpose without
charge.
II.
The City agrees to pay the Contractor $7,500.00 to provide the
Festival. No Contract funds will be used for any administrative or other
recurring costs. Expenses will be limited to fees for bands or performers,
promotion and printing for jazz musical activities sponsored by the Jazz
Festival Society and expenses for the Memorial Coliseum.
The expenses for the Festival at the Memorial Coliseum will be the
responsibility of the Texas Jazz Festival Society. As a co-sponsor of the
free events, the City will, through the Park and Recreation Department,
grant a waiver of rental fees only, for the Coliseum. The expenses of
stage hands, labor, spotlights, security, air conditioning, table and
equipment rental will be the sole responsibility of the Texas Jazz Festival
Society.

The City's share of gross receipts will be $7,500.00. The City will
not provide nor consider any request for funding of any future event of the
Contractor if the Contractor does not pay the City $7,500.00.
IV.
Contractor shall recognize the City of Corpus Christi as a sponsor on
all advertisements and publications made regarding the activity which is
the subject of this contract.
V.
The Contractor further agrees that a statement of revenues and
expenditures and- an activity report including the estimated audience for
the program will be submitted to the City within 60 days after July 14,
1985, so that the application of the above amount to eligible expenses can
be verified and the cost of the event can be sufficiently related to the
benefits received by the citizens of Corpus Christi.

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
