AUTHORIZING THE EXECUTION OF THE DOCUMENTS NECESSARY FOR THE
ACQUISITION OF PARCEL 4 IN CONNECTION WITH THE SOUTH STAPLES
SANITARY SEWER TRUNK EXTENSION; APPROPRIATING $9,500; AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be authorized to execute the
documents necessary for the acquisition of Parcel 4 in connection with the South
Staples Sanitary Sewer Trunk Extension, a substantial copy of which is attached
hereto and made a part hereof, marked Exhibit "A."
SECTION 2. That there is hereby appropriated $9,500 out of the
No. 250 Sanitary Sewer Bond Fund.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need to take
immediate action to preserve and protect public property by expediting the
purchase of land necessary for the abovementioned South Staples Sanitary Sewer
Trunk Extension, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances or
resolutions at three regular meetings so that this ordinance is passed and shall
take effect upon first reading as an emergency measure this the 2nd day of July,
1985.

THAT Greford N. Rogers end wife, Annelle S. Rogers,
of the County of Nueces, State of Texas, for and in consideration of the tum of
Nine thousand Dollars and no cents ($9,000.00)
to us in hand paid by the City of Corpus Christi, Nuecea County, Texas, the
receipt of which is hereby acknowledged, have granted and conveyed, and by these
presents do grant and convey unto the City of Corpus Christi, Texas, a municipal
corporation duly incorporated under and by virtue of the laws of the State of
Tema, its successors and legal representatives the free end uninterrupted use,
liberty, privilege, and easement of going in, on, over, under and along a
certain tract of land situated in Nueces County, Texas and being described as
follows;

Being a ten foot wide strip of land out of
Lot 8, Section 6, Flour Bluff and Ermine/
Farm and Garden Tracts, shown by plat re-
corded 1n Volume A, Pages 41-43, Map Re-
cord., Nuces County, Texas, and further
described by metes and bounds as follows:
Beginning at the current south corner of
said Lot 8, being a point on the westerly
right of way of South Staples Street
forty feet from the centerline of South
Staples Street;
Thence N. 61° W., 10.00 feet to a point
being the east corner of Buckingham
Estates Unit 1 Subdivision, shown by plat
recorded In Volume 48, Pages 37-39, Map
Records, Nuecea County, Texas;
Thence N. 29' E., 330.00 feet to a point;
Thence S. 61' E., 10.00 feet to a point on
said vest right of way of South Staples
Street;
Thence S. 29' W., along said right of way
330.00 feet to the point of beginning and
containing 0.076 acres, more or less.
Together with a 30 foot temporary construe-
. tion easement west of and adjacent to the
permanent easement. Said temporary cons-
truction easement to be used for working
room and storage of materials during con-
struction phase. Said temporary con-
struction easement to be abandoned
upon completion of project and ground area
to be restored to as was or better condi-
tion.

It is agreed:
(1) Only such excavated material and equipment as necessary for
construction on Grantors property to be stored in temporary
easement. during time of construction.
(2) Construction work shall not exceed five (5) work days and
clean-up shall not exceed two (2) work days, excepting
inclement weather or acts of God.
(3) The permanent easement shall be back-filled and compacted in
a good workmanlike manner. The temporary and permanent
easement area shall be re -surfaced where existing asphalt
surface is disturbed with asphalt equal to the existing
asphalt surface.
(4) Grantor, his business invitees, customers, agents and
employees shall have continuous and unobstructed ingress and
egress to Grantor's business on the subject property during
the construction period.
Together with the free ingress, egress, and regress to and for the City of
Corpus Christi, Texas, for the purpose of constructing. reconstructing.
laying, and keeping sanitary sewer lines, and for the purposes of maintain-
ing, servicing, repairing, and inspecting said lines under, on, and along
said tract.
To have and to hold, all and singular, the rights and privileges aforesaid
to the City of Corpus Christi, Texas its successors and legal representa-
tives, for the proper use as a sanitary sewer easement and sanitary
right-of-way, for so long as used for such purpose, and if the use for said
easement and way of said uses be ever abandoned. then in that event, the
aforesaid rights and privileges shall cease.
