A RESOLUTION
WHEREAS, the State Department of Highways and Public Transportation
has submitted a copy of Minute Order 83284, passed by the State Highway and
Public Transportation Commission on June 21, 1985, as follows:
WHEREAS, in Nueces County on State Highway 258, from east end of
Airline Interchange to west end of Oso Bay Bridge, a distance of approximately
3.0 miles, the State Department of Highways and Public Transportation is
preparing plans for construction; and
WHEREAS, the City of Corpus Christi will have certain responsibilities
in the project;
NOW, THEREFORE, the Engineer -Director is directed to tender the
following proposal to the City of Corpus Christi:
Provided the City will:
1. Provide for the construction of continuous curb and gutter where
none now exist as may be necessary for a complete project with the exception of
pavement and its support.
2. Assume responsibility for the construction of driveways and
sidewalks where none now exist should they be deemed necessary now or in the
future and agree to make such installations in accordance with governing
policies and regulations of the Department.
3. Provide for installation, operation and maintenance of street
lighting in accordance with governing policies and regulations of the
Department.
4. Maintain that portion of the work which is its responsibility in
accordance with present maintenance agreement, and agree to regulate traffic and
prevent encroachment on the right-of-way, all in accordance with governing
policies and regulations of the Department.
The State Department of Highways and Public Transportation will:
1. Provide for construction at an estimated cost of $27,812,125.
2. Maintain that portion of the work which is its responsibility in
accordance with present maintenance agreement.
Upon acceptance of the provisions of this Order by the appropriate
officials of the City of Corpus Christi, the Engineer -Director is directed to
proceed with plans for construction and after the City has fulfilled its
responsibilities, proceed with construction in the most feasible and economical
manner, financing the cost with funds previously approved in the 1984-85
(Category 3) 14 Month Letting Schedule.

It is understood that the City may discharge its construction
obligations as outlined herein in any manner as it may elect. In the event the
City desires the State to include its portion of work in the State's
construction contract, the Engineer -Director is hereby authorized to enter into
agreement with the City for such work and its cost as may be agreed upon.
This Order shall become operative upon acceptance by the City of
Corpus Christi and if not accepted within 90 days of the date hereof, the action
herein contained shall be automatically cancelled.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the Minute Order of the State Department of Highways
and Public Transportation Number 83284, dated June 21, 1985, is hereby accepted
and adopted by the City of Corpus Christi as provided for by its terms.
SECTION 2. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need to
accept the abovementioned Minute Order at the earliest practicable date, such
finding of an emergency is made and declared requiring suspension of the Charter
rule as to consideration and voting upon ordinances or resolutions at three
regular meetings so that this resolution is passed and shall take effect upon
first reading as an emergency measure this the 16th day of July, 1985.

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
