HomeMy WebLinkAbout18928 ORD - 07/23/1985AN ORDINANCE AMEND ORDINANCE NO. 18703 CLOSING AND ABANDONING A BLANKET GAS PIPELINE EASEMENT BY CORRECTING ERRORS IN DESCRIPTION AND RECORDING DATA; AND DECLARING AN EMERGENCY. WHEREAS, a blanket gas pipeline easement closed by Ordinance No. 18703 was erroneously described as being located in Lot 15, Block 3, Manor Terrace as recorded in Volume 270, Page 50, Deed Records, Nueces County, Texas, when in fact, said blanket gas pipeline easement is located in Lots 15 and 16, Block 3, Manor Terrace and is recorded in Volume 270, Pages 55 and 56, Deed Records, Nueces County, Texas: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance No. 18703 is hereby amended to read that the portion of the blanket gas pipeline easement recorded in Volume 270, Pages 55 and 56, Deed Records, Nueces County, Texas, as contained in Lots 15 and 16, Block 3, Manor Terrace, shown by plat in Volume 45, Pages 237-238, Map Records, Nueces County, Texas, be and the same is hereby closed for public use and every municipal purpose provided the property is replatted at applicant's expense. The above described gas pipeline easement is hereby abandoned to Commonwealth Savings Association of Nueces County, Texas in accordance with the laws of the State of Texas, and for the service and interest of the inhabitants of the City of Corpus Christi, Texas. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need to amend the ordinance closing and abandoning the abovementioned gas pipeline easement at the earliest practicable date, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 23rd day of July, 1985.
